Since January 2021, changes have been made to cadastral registration.

Now, instead of a passport and an extract from the Unified State Register, a cadastral extract from the Unified State Register is issued. A message about this was recorded in the letter of the Ministry of Economic Development No. 39682-Va/D23i dated 12/22/2016.

The cadastral passport is an important document when registering various transactions and conducting operations with real estate. You will definitely need:

  • if the owner of the garage box decided to privatize it;
  • when registering a real estate alienation transaction. This could be a transaction related to the sale, gift, or execution of a will;
  • if the owner of the garage box decided to rent it out for a period of more than a year;
  • to provide a garage as collateral when receiving a loan;
  • if the state plans to move or demolish the GSK, then a passport is also needed to receive compensation or another garage box.

Cadastral passport

This is an official document that indicates the category of real estate. It provides a complete description of the object. In accordance with the Federal Law “On the Real Estate Cadastre”, it is presented in the form of an extract from the state cadastre. The form of submission was approved by Order of the Ministry of Justice No. 32 of February 18, 2008.

A cadastral passport is issued for all buildings, including finished objects and unfinished buildings. The garage is no exception. The extract allows you to formalize ownership and register the object with the registering authority. Only after this can you be considered a full owner and have full control over the garage box.

It is important that the document shows information about the cadastral value of the garage. It is used as a basis for calculating tax due. Once you receive your statement, it is important to make sure that it does not exceed the market price. If this happens, an application for recalculation of the cost is submitted. If you do not do this, you will have to pay increased taxes.

Information contained in the cadastral passport

It contains information about the individual characteristics of the building that allow it to be identified. The passport must contain the following:

  • land plan;
  • garage information;
  • data on directional angles of the site;
  • geographic coordinates entered into the electronic map of Russia;
  • cadastral numbers of neighboring plots.

Why is a cadastral passport needed?

A garage is equated to real estate objects with which alienation transactions can be made. A cadastral passport is required in the following situations:

  • registration of donation or inheritance;
  • garage sale or exchange;
  • privatization, carried out by transferring from cooperative to private ownership.

Note! The presence of a building in the GSK and a membership book does not yet provide the right to dispose of it. To do this, you need to register the property and obtain a cadastral passport.

Features of receiving at GSK

To obtain a real estate passport from GSK, it is worth taking into account the fact that registration of a garage as a property is possible with full repayment of the share.

After paying the entire amount of share contributions, the owner of the box can start privatizing it.

If no one before him from GSK has registered a separate garage as a property, then the list of papers to complete this procedure will be quite large.

To obtain papers for a garage box, you must obtain official consent from the chairman of the cooperative.

Refusal of registration

It also happens that the document is refused. There must be a specific reason for this. Among the possible:

  • Lack of data on the building in the Rosreestr database.
  • The garage was erected without the appropriate permit.
  • There are no title documents for the plot.
  • Incomplete package of documents.

Only after all deficiencies have been eliminated can the package be submitted again, otherwise it will be returned again.

How to obtain a cadastral passport for a garage at GSK: general algorithm of actions

How to obtain a cadastral passport for a garage at GSK? Before issuing a cadastral passport for a separate box, you must obtain technical documentation for it. To do this, a BTI specialist is invited to measure the box and prepare a technical description. Based on this data, you need to apply for a technical passport for the garage, the state duty for which is 800 rubles.

If you have a technical passport, a certificate of contribution of a share, a receipt for payment of the state duty and the owner’s passport, an application for obtaining a cadastral document is drawn up. All papers are submitted to Rosreestr for registration. The document is ready in 5 days.

The cadastral document is unlimited. But when registering transactions, if it was received more than 5 years ago, its re-registration is required.

Also, a new passport should be obtained if redevelopment or reconstruction was carried out in the garage box.

A cadastral passport for a garage without the same paper for the land does not give the right to carry out an operation to alienate real estate.

Validity period of the cadastral passport

The cadastral passport is not limited by its validity period. It must be reissued only in exceptional situations or when the form is damaged. If reconstruction or redevelopment work has been carried out in the box, the passport must be changed. At the same time, it is impossible to make a transaction with a garage that does not have a cadastral passport for the land underneath it.

As a result, it is important to make a cadastral passport in advance. It is one of the necessary documents for transactions with a garage. Even if there is no need to sell it, the document will be required to formalize ownership and confirm it in court if a dispute arises.

Duration and amount of state duty

The amount of the state duty and the deadlines for the production of documentation by the cadastre service are established in Order No. 343 of the Ministry of Economic Development.

The electronic version is prepared on the Rosreestr website within 2-3 days after submitting the application, the state duty will be 150 rubles for individuals and 300 rubles for organizations for one copy.

The paper version will be ready only after 5 working days. A fee for it will have to be paid in the amount of 200 rubles for citizens and 600 rubles for legal entities.

If registration is carried out through the MFC, the production time will increase by 2 days and amount to 7 working days.

Collecting documents

The entire registration procedure can be divided into three stages: collecting a package of documents, submitting an application, receiving a document.

Below we present the complete package of documents for obtaining a passport:

  • an application from the owner or the owner’s representative, whose authority must be confirmed by a notary;
  • applicant's passport;
  • technical passport of the object;
  • document confirming ownership (purchase/sale agreement, gift, inheritance);
  • receipt of payment of state duty.

When preparing a cadastral passport, you need to pay attention to some nuances:

  1. The owner can exercise the right to choose in what form he wants to receive a passport. There are paper and electronic versions.
  2. It is important to remember that in electronic form a document is protected only by a digital signature, and the signature on a standard paper copy is affixed by an employee of the Cadastral Chamber.

What documents are needed

When registering a cadastral document for the first time by the owner for a separate box in the GSK, the following papers will be required:

  • charter of the cooperative;
  • municipal permission for the construction of a civil building complex;
  • documentation for GSK land: lease of land from the municipality or ownership;
  • certificate of registration of GSK with the tax office;
  • extract from the Unified State Register of Legal Entities;
  • decision of the general meeting on the appointment of the chairman of the State Committee;
  • permission of the chairman for privatization;
  • owner's passport;
  • statement;
  • certificate of redemption of the share.

If the garage owner is not the first one who needs a passport, then the list of papers will be insignificant:

  • owner's passport;
  • certificate of payment of the share;
  • certificate of ownership;
  • application for a cadastral document.

Documents for the technical passport of the garage

A written application can be submitted either by the owners themselves, personally, or by their authorized representatives, who receive such a right on the basis of a power of attorney signed and certified by a notary.

The documents that are attached to the application may be different, depending on different reasons and conditions. For registration, copies are submitted along with the originals so that the specialist accepting the application can objectively assess the accuracy of the submitted documents. These documents must contain clear, easily readable, legible entries, without corrections, made not in pencil, but in permanent ink.

  • garage owner's passport.
  • title documents for the garage itself;
  • an extract from the cadastre, which should contain information about the ownership of the land on which the building is built;
  • receipt of payment of state duty.

Drawing up an application

The application is submitted on a form approved by Order No. 743 of the Ministry of Economic Development. The application indicates the cadastral number and address of the garage, as well as the cadastral number of the land plot where the structure is located, and information about the applicant is entered.

The form of submission of the document is noted: electronic or paper, the place where it will be received: Rosreestr branch, post office, MFC or e-mail. An employee of Rosreestr checks the availability of all documentation.

You can fill out an application on the USRN website by sending an application electronically, or obtain a form from a Rosreestr specialist.

Document structure

The passport, a sample of which you will find below, contains important characteristics of the object by which it can be identified. The structure of the document includes such sections as:

  • Type of real estate.
  • The date the object was entered into the cadastre and its number.
  • Number according to inventory.
  • The region where the object is located.
  • Main characteristics of the garage.

It is necessary to enter data on the plot of land, namely:

  1. The location of its borders.
  2. Location of the garage on the site.

Important! A mandatory element is a graphic image of the object drawn up by a specialist.

Sending papers to the authority

After collecting and processing all documentation, you need to transfer it to Rosreestr. You can do this in several ways:

  • personal appeal to Rosreestr or MFC;
  • using electronic services on the Rosreestr website. In this case, you need to have all papers in electronic form;
  • sending documents through the post office;
  • with the help of a legal representative: it is necessary to issue a notarized power of attorney.

To carry out any real estate transactions, the garage owner is required to have a cadastral passport. Applying for it is quite simple, having all the required documents. Difficulty may arise in a situation where none of the owners have registered the garage in the cadastral cooperative.

Package of documents

To submit an application for the formation of a cadastral passport of a building, you must collect and submit the following data:

  1. Owner's statement.
  2. Passport.
  3. Technical passport of the object.
  4. A document that is the basis for registration of property rights in the future: purchase and sale agreement, deed of gift, certificate of inheritance.
  5. Receipt for payment of state duty.
  6. If the submission occurs through a representative, then the package must include a power of attorney and a passport of the authorized person.

Many who have not yet issued a document are sure that it has an expiration date, but this is not the case. The reasons why it may have to be reissued are loss, theft or damage. The case when a document needs to be updated is during an alienation. And then a similar process is required if more than 5 years have passed since the issuance of the cadastral passport.

How to privatize land

How to register land ownership? The most common method is privatization. This is a procedure for transferring ownership from the state to a private person, since the land under the buildings belonged to the state, which allocated the land for use

. Theoretically, anyone can privatize a piece of land. But the owner of the building has the priority right to privatize the land, which gives him the right to purchase the plot.

The first step will be to obtain documents for the land plot on which the garage is located. To do this, you need to carry out land surveying with the help of an engineer. He will take all the necessary measurements and prepare the necessary documents for registration

Cadastral passports and property documents are issued separately for the site and for the building.

To register ownership, the consent of the administration will be required, since most of the lands under the GSK belong to the municipalities. After receiving ownership rights, each former shareholder, and now the owner, will have a share in the common property.

How to draw up a document

Until 2012 garage owners had technical passports in their hands, which were issued at the BTI. They indicated the inventory characteristics of buildings. Since 2013 The concept of a cadastral passport is introduced. At its core, the document is an extract from the state register, which indicates the cadastral number of the object and the main characteristics of the garage. The presence of a document gives legal force to the transaction, since it contains all the necessary information about the technical parameters of the object.

To questions from users about how a cadastral passport for a garage is prepared, there is only one answer - through the State Cadastre. Like any property, real estate requires its own inventory. That is, it is assigned an inventory number and the exact address of the object’s location is indicated. Next, it is necessary to characterize it in terms of occupied space, linear dimensions, building materials and finishing.

The presence of an underground floor and inspection hole should also be noted. If water supply systems or electricity are connected to the garage building, this is also indicated in the passport.

The same document states the date when the garage was built and the percentage of wear and tear. The cost of the object is determined. In the future, based on its value, the new owner, who has ownership rights to the garage, will pay property tax.

If a garage has a foundation, it is characterized as a permanent structure. In this case, two passports are required - for the land plot and the garage itself. Without a foundation, a building is considered temporary; it can be easily dismantled and transported, so the so-called “shells” are not registered.

Owners who received a technical passport before 2013 do not need to receive a cadastral equivalent for a garage. All necessary specifications are contained in this document.

In what cases is a cadastral passport required:

  • when drawing up a purchase and sale agreement;
  • to receive compensation if the city authorities decide to demolish the building;
  • for other real estate transactions, for example, by gift or will;
  • to have evidence to challenge the established property tax.

Developed urban planning involves spot development within the city, where laid communications do not require large capital expenditures. Therefore, the “decoration of the historical part of the city” in the form of garage arrays is often subject to demolition by the city authorities. If the owner has the building's inventory certificate in his hands, he can receive compensation that will be enough to purchase another building in a less expensive area or to build a new one.

The law does not stipulate the validity period of the cadastral passport for a garage if redevelopment has not been carried out inside the building. There is an unspoken five-year period after which a re-inventory is required. An outdated document may not be accepted by the bank as collateral when drawing up a loan agreement, because over a long service life the building could become unusable.

Application via GSK

As already mentioned, holders of garage cooperative certificates are deprived of the right to own an object and conduct any transactions in relation to it. Often the land plot is in the state ownership of the municipality, and garage owners use it under a lease agreement.


The territory of the GSK is also an indivisible land plot, therefore the only way to transfer it to the owners of cooperatives is through privatization on the basis of common shared ownership. An application signed by all members of the GSK is sent to the municipality.

Attached to it:

  • list of cooperative members;
  • constituent documents confirming the legal status of the GSK and copies of the certificate of ownership;
  • Additional documents may be required depending on the municipality itself.

If the right of ownership, use and disposal has not been registered with the Federal Cadastral Chamber, then the object is recognized as non-existent. Then the owner may be deprived of property without receiving compensation.

Financial side of the issue

Of course, some amount will be required for documentation. By law, this procedure is free of charge. The only payment is the state duty fixed by law

. It is different for individuals and legal entities.

Individuals will have to pay 200 rubles for a paper version, 150 for an electronic version. The cost for legal entities is 600 rubles for a paper passport, for an electronic passport – 300 rubles.

Reasons for refusal

It happens when, instead of a ready-made CP, a person may only be given a notification. This happens if the applicant is denied a passport.

Reasons for refusal:

  • the system does not contain specific data about the specified structure;
  • there is information, but it cannot be officially disclosed, it is prohibited by law;
  • there are claims regarding the papers provided.

Important: the citizen must be given a detailed indication in the notification of what exactly was the reason for the refusal. Perhaps he will be able to eliminate the problem and contact him again. However, all questions can be asked directly to a specialist at the MFC. Or use reference numbers.

Validity dates

The validity period of a garage technical passport is not legally established. For example, technical passports issued before 2008 are equivalent to a cadastral passport.

But there are situations when specialists from some institutions may ask to update the technical passport. This is due to the fact that its information may already be out of date, and planned inventories are carried out once every five years.

A garage, as one of the types of real estate, is recommended to be registered as a property. The lack of documents about this can lead to dire consequences in the future: sudden demolition without compensation, inability to sell or donate. You should know all this when buying a garage and give preference to those options when the owner has the documents necessary to register ownership of the building.

Registration of a technical passport can be primary or repeated. In any case, you must contact the BTI with an application. The appeal can be either personal or through legal representatives who have a properly executed power of attorney.

The procedure for registration and the list of necessary documents will depend on the location of the garage:

  • as part of a garage cooperative;
  • is a detached individual building.
