What is cadastral work
Each property has unique characteristics and features - boundary points, area, number of floors, height. To transfer them into official documents and databases, it is not enough to measure with a tape measure or “by eye”. This may lead to overlapping or crossing boundaries, inaccurate indication of the location of the building on the site, and other errors. Therefore, the goal of cadastral work is to obtain objective, complete and reliable data about real estate, its characteristics and coordinates.
Cadastral work on a site may involve placing boundary markers in kind. coordination of boundaries.
The essence of cadastral activities and the implementation of cadastral work is as follows:

What is complex cadastral work? This is a special type of cadastral activity that is carried out on large groups and arrays of objects. Read more about this below.
The essence of cadastral work is to survey a site or building and determine its characteristics
Regulatory acts
The main governing documents for cadastral activities are Federal Laws No. 218-FZ and 221-FZ. They contain general rules and stages of cadastral work, requirements for the form and content of documents, and the procedure for their submission to Rosreestr. Also, cadastral work is carried out in accordance with the following regulations:
- Order of the Ministry of Economic Development No. 921 ();
- Order of the Ministry of Economic Development No. 861 ();
- Order of the Ministry of Economic Development No. 953 ();
- Order of the Ministry of Economic Development No. 975 ().
Orders of the Ministry of Economic Development of the Russian Federation provide for special requirements for the accuracy of cadastral work, measurement errors, and filling out documents. They will be taken into account by the cadastral engineer who will carry out the work. The procedure for performing cadastral work cannot be violated, otherwise Rosreestr will refuse to carry out registration.
Cadastral works on land plots
They mainly relate to cadastral registration/removal, but may be related to the donation of an object, the desire to build a house or other structure on it. The initiator of the work is both the landowner himself and government agencies that need to obtain certain data regarding the site.
Key cases in which it is necessary to carry out cadastral work on a land plot:
• Providing land for use, leasing for payment of rent. • Redistribution of land plots. • Donation/sale of land. • Withdrawal of a land plot from use. • The need to clarify the boundaries of the allotment. • Consolidation of several land plots. • Identification of lands disturbed as a result of human activity or under the influence of natural factors. • The emergence of disputes about land ownership boundaries. • The need to build a residential or industrial structure on a land plot, or to conduct agricultural work.
Cadastral documents are created on the basis of a boundary plan, which requires a clear clarification of the boundaries of the site, as well as determining the degree of pollution and damage to the territory (if it is subject to conservation or reclamation).
When surveying, the following points are taken into account:
• The boundaries of the plots should not intersect (including city and state plots, settlements). • The area of the territory must comply with urban planning regulations. • The site should not wedge into neighboring sites and interfere with their use. The drawn up boundary plan is consistent not only with all owners of this site, but also with the owners of neighboring territories.
When are cadastral works carried out in 2021?
Cadastral work must be carried out in each case when information is required to be entered into the Unified State Register of Real Estate. The provision of cadastral services may include:
- determination of the border points of the newly formed area - when separating government bodies, during division, separation or merger;
- when clarifying boundaries, eliminating registration errors (for example, when overlapping the boundaries of neighboring plots);
- registration of a newly built facility;
- making changes to the Unified State Register of Real Estate after reconstruction, redevelopment, refurbishment of buildings and premises;
- to deregister an object that has lost its existence (for example, as a result of demolition, destruction).
Let's look at what complex cadastral works are and where they are used. Special rules apply if complex cadastral work is carried out. They are carried out in relation to a group of objects and territory. For example. complex cadastral work is needed for urban planning activities and zoning of territories. Most often, complex cadastral work is ordered through tenders and government procurement.
The result of complex cadastral work
As a result of carrying out complex cadastral work (Part 2 of Article 42.1 of the Law on Cadastral Activities):
- the location of the boundaries of land plots is specified;
- the location of buildings, structures and unfinished construction objects on them is established (specified), information about which is contained in the Unified State Register of Real Estate;
- the formation of land plots on which buildings (including apartment buildings) and structures (except for linear objects) are located is ensured;
- the formation of public land plots is ensured, including streets, embankments, and public gardens;
- Correction of registry errors in information about the location of the boundaries of real estate is ensured.
Based on the results of such work, a map-plan of the territory is prepared, which contains the information necessary for entering into the Unified State Register of Land Registers about land plots, buildings, structures, unfinished construction objects located within the territory where such work was carried out. Based on the approved map-plan of the territory, information is entered into the Unified State Register of Real Estate (Article 42.4 of the Law on Cadastral Activities, Clause 7, Part 2, Article 14 of the Law on State Registration of Real Estate).

What services do cadastral engineers provide?
Every person has at one time or another encountered the registration of their rights to land plots, residential buildings, apartments, garages and other real estate properties. To register his property, a citizen turns to notaries, realtors, law firms, any other intermediaries who have knowledge in this area, and since 2010, cadastral engineers. A cadastral engineer is approached by those who need to prepare documents for submission to Rosreestr in order to enter information (changes) about a property in the Unified State Register or remove a property or land plot from the state cadastral register.
Let's take a closer look at what services cadastral engineers provide?
For ten years now, the phrase “cadastral engineer” has been on everyone’s lips. Almost everyone knows that a cadastral engineer is engaged in land surveying. Previously, this work was carried out by land management organizations. The state, in order to demonopolize this area, including reducing the costs of applicants, has provided the opportunity for cadastral engineers to provide such services; since 2013, they have also been preparing technical plans for capital construction projects (houses, apartments, premises, structures, etc.).
A cadastral engineer carries out cadastral activities in relation to land plots, buildings, premises, structures, and unfinished construction projects. The result of cadastral work is documents (land survey plan, technical plan or inspection report for capital construction projects), which the cadastral engineer must transfer to the customer for submission to the cadastral chamber.
Under what circumstances are these documents needed:
1. Land survey plan - when preparing documents for registering one or more land plots and changing the area, as well as when allocating a share, including from agricultural land or the formation of land plots, taking into account the project for surveying a land plot or land plots.
2. Technical plan - when preparing documents for registering a capital construction project: a building, structure, premises (apartment/room) or an unfinished construction project, accounting for its changes or accounting for its part.
3. Inspection report - when preparing documents for deregistration of a building, structure, premises or an unfinished construction site (for example, when a house burned down or the structure was dismantled).
It should be noted that cadastral engineers are not employees of the cadastral chamber, they are persons who have a qualification certificate and who carry out their activities either as individual entrepreneurs or as part of an organization.
In the case of the first option, the cadastral engineer does not require any additional licenses, only a qualification certificate.
Cadastral activity is the performance by a cadastral engineer of work in relation to real estate, as a result of which the preparation of documents containing information about such real estate necessary for cadastral registration is ensured. At the same time, only cadastral engineers have the right to engage in cadastral activities. The degree of customer participation in state cadastral registration procedures depends on the qualifications of the cadastral engineer.
In accordance with federal legislation, for a cadastral engineer entering knowingly false information into a boundary plan, an act of coordinating the location of land boundaries, a technical plan or a survey report, provided that there is no criminal offense, he faces administrative punishment or disqualification.
Control of the activities of cadastral engineers in terms of their compliance with the requirements of the Federal Law of July 24, 2007 No. 221-FZ “On Cadastral Activities” is carried out by a self-regulatory organization if the cadastral engineer is its member.
The actions of a cadastral engineer within the framework of a contract for cadastral work on drawing up a boundary plan, technical plan and survey report can be challenged in court.
The list of all certified cadastral engineers in the Russian Federation can be found on the website of Rosreestr, also the list of certified cadastral engineers for the Ulyanovsk region is posted on the website of the Regional Land and Property Center OGKU (https://regioncentr73.ru/informatsiya/kadastrovye-inzhenery/) .

Other events
There are various activities included in the complex of cadastral works.
Registration in the cadastre
In this case, it means preparing all the necessary documentation and materials. Every residential and non-residential real estate property is subject to this procedure, regardless of what the form of property is, what it will be used for, etc.
Information from accounting is used to fill out various types of paperwork. Based on the accounting, information is entered into tables and graphs, and statistical reports are generated.
Creating a boundary plan
To determine the specific boundaries of the plot, it is necessary to formulate a boundary plan, i.e. a document containing information about the boundaries and size of the land. It is drawn up after measuring the size of all objects, agreeing on boundaries and other actions.
For real estate units, existing materials are analyzed, collected and processed, after which final documentation is issued.
Providing a cadastral document
In order for the owner to legally own his own property, he must have a cadastral passport containing all the general, technical and legal data that allows him to register the real estate.
A cadastral passport is a document required for transactions with plots of land, performing work on them, resolving conflicts, etc. The form and procedure for filling out a passport is determined by the Ministry of Economic Development.
