The housing registration certificate is an extremely important component. Without it, it will not be possible to sell the property under any circumstances. What does a technical passport for an apartment look like? First of all, let's try to understand what kind of paper we will be dealing with. Maybe it's not that important after all?

Real estate registration certificate is a document presented in the form of a small booklet in A3 format. It contains information about the owners of the territory, as well as its technical characteristics. Such paper does not have cadastral information.

A technical passport is used for a variety of purposes. For example, when redeveloping a territory or for issuing a cadastral passport. It is impossible to do without this paper.

Obtaining a technical passport from the BTI

You can order and issue a technical passport for a property at the technical inventory office.

This is a government agency that issues certificates, extracts, technical and cadastral passports and other documents relating to real estate.

A registration certificate is issued for a fee, the cost can be clarified at the local BTI. The passport will be produced within one to two weeks, but for an additional fee you can order urgent production, which will take several days.

What does the technical passport of a property look like? As already mentioned, this is a small A3 book containing important technical parameters of an apartment, house or land. What exactly can you see in it?

The technical passport usually indicates:

  • number of floors;
  • purpose of the premises;
  • visual plan of the territory;
  • communications carried out;
  • finishing materials;
  • cost of the object;
  • information about property owners;
  • area of ​​premises;
  • date of construction and commissioning;
  • information on major repairs carried out;
  • redevelopment data.

There is no third-party information in the document. Moreover, such an extract cannot serve as evidence of ownership of real estate. But it is not issued to all citizens.

A technical passport is a document that contains the characteristics of a capital construction project. It was previously issued as a result of a technical inventory of such objects. It was needed to account for these objects and state registration of rights to them.

From March 1, 2008, technical inventory was replaced by cadastral registration. Based on its results, a cadastral passport was issued. However, for capital construction projects, a transition period was established until January 1, 2013. Therefore, during this period, technical passports were still issued on the territory of the Russian Federation. Currently, such a document is not issued. However, in some cases it may be required to draw up a technical plan. A technical passport is a document that was previously issued based on the results of a technical inventory of capital construction projects. On the basis of such a passport, their technical registration was carried out, they were included in the Unified State Register of Capital Construction Projects. The technical passport contained the characteristics of the property that individualized it. It was needed to enter information about the property into the Unified State Register of Real Estate during the state registration of rights to it. The technical passport was issued until January 1, 2013. At the same time: - until March 1, 2008, it was issued without fail and confirmed the technical inventory. After this date, instead of technical registration of real estate, cadastral registration began in accordance with the Law on Real Estate Cadastre; — from March 1, 2008 to January 1, 2013, technical passports were issued depending on the region in which the facility is located. During this period, a transition period was established to account for buildings, structures, premises and objects of unfinished construction. On the territory of the Russian Federation, both technical and cadastral passports were issued if a new procedure for recording such objects was introduced. Everything depended on the region, since the new order was introduced in stages. From January 1, 2013, only a cadastral passport was issued to confirm cadastral registration. From January 1, 2021, cadastral registration and state registration of rights to real estate are carried out in a single register - the Unified State Register of Real Estate. Cadastral registration, as well as state registration of rights, is confirmed by an extract from the Unified State Register of Real Estate. However, in some cases you may need a previously issued technical passport; we will talk about this further. Today, a technical passport of an apartment building can be issued as part of technical accounting (that is, technical inventory and certification) for the purpose of accounting for the housing stock. For the purposes of cadastral registration, the technical passport of an apartment building, like any other object, is currently not used. Currently, a technical passport, like a cadastral one, is not used for cadastral registration. To do this, you need a technical plan. Therefore, cadastral registration will not be carried out on the basis of a technical passport (issued before January 1, 2013) or a cadastral passport (issued before January 1, 2021). Please note that in some cases you may need a previously issued technical passport to draw up, for example, a technical plan of a building or non-residential premises. As mentioned above, a technical passport (including for a non-residential building) is currently not issued. A previously issued technical passport of a non-residential building is not used for cadastral registration. Such accounting is carried out on the basis of a technical plan drawn up for a non-residential building. At the same time, you may need a previously issued technical passport for a non-residential building to draw up a technical plan (clause 20 of the Requirements approved by Order of the Ministry of Economic Development of Russia dated December 18, 2015 N 953; hereinafter referred to as the Requirements for the preparation of a technical plan): - for the building itself; - for premises in this building. The technical plan for both the building and the premises will be prepared according to the technical passport issued before January 1, 2013, only if there is no design documentation for the building and permission to put it into operation. A technical passport for non-residential premises, like any other real estate, is not currently issued. For cadastral registration, the previously issued technical passport of non-residential premises is currently not used. Cadastral registration can be carried out on the basis of a technical plan drawn up for such premises. At the same time, you may need a technical passport of a non-residential premises, issued before January 1, 2013, to prepare a technical plan for this premises if the building (structure) in which it is located does not have design documentation and permission to put it into operation (clause 20 of the Requirements for the preparation of a technical plan).

Purpose of paper

At the moment, appropriate documentation is required in the following cases:

  • if it is planned to allocate shares in the object;
  • a person carries out redevelopment;
  • you need to issue a cadastral passport;
  • property disputes arise;
  • I want to conclude a legally significant real estate transaction (for example, sell or donate an apartment).

In addition, a technical passport is needed for privatization. There is nothing difficult or incomprehensible in its design, but to achieve the task you will have to try hard.

Legislative regulation of the issue

It is formed by BTI employees only after a special primary inventory, carried out immediately after the house is put into operation.

This takes into account who exactly was involved in the construction :

  • if a house is being built by a developer represented by a company, then its representative must receive the paper;
  • if a house is being built by a private person, then the owner of the building is obliged to independently deal with all technical issues.

The technical passport contains detailed and reliable information about housing , and after studying it you can find out the following information:

  • the exact address of the property, number of floors, area and year of construction, as well as the purpose of the building;
  • home owners;
  • technical plan of the structure, and it certainly shows all the load-bearing elements, utility networks, window and door openings, ventilation system shafts and laid drainage;
  • explication of premises;
  • information about the existing layout, as well as about the reconstruction carried out;
  • the inventory value determined by BTI employees is indicated.

No real estate transaction can be carried out in the absence of this document, so it is required in many cases.

It is with the presence of a technical passport that various disputes regarding property can be resolved.

To whom it is issued

What does a technical passport for an apartment look like? Previously, we studied an example of such a paper. In general, it vaguely resembles a cadastral passport, but the content of the documentation differs from each other.

Technical passports are not issued to all citizens. They can be issued by:

  • territory owners;
  • residents of a municipal apartment;
  • heirs;
  • government bodies and services;
  • official representatives of the listed categories of the population.

For minor children, documents must be ordered and received by their legal representatives. Guardianship permission is not required for this. But to deal with property owned by a minor, you will have to enlist the support of authorized services. Without this, it will be impossible to carry out the operation, since such an act is completely contrary to the laws in force in the Russian Federation.

Coping with such a task is much easier than it seems. Especially if you prepare for it in advance. You don’t even need to know what the technical passport for an apartment looks like. A booklet of the established form will be drawn up and issued directly to the authorized bodies.

Internet technologies to help

Is it possible to request a technical passport for a territory via the Internet? It's no secret that most papers in the Russian Federation can be ordered remotely. For example, a cadastral or civil passport. What to do with the registration certificate?

It can also be requested via the Internet. For example, using the service “Government in the First Rows”. Then a standard form with the technical parameters of the territory will be produced in about a week.

It is better to check with the authorized bodies for more accurate information. Only there they will be able to tell you how long it takes to prepare documents for an apartment. Overall, this is not such a long operation.

What is the price

You no longer have to think about finding an answer to the question: what does a technical passport for an apartment look like? But how much will it cost to issue a technical passport?

There is no exact state duty for a standard document in Russia. Therefore, you will have to check the price of the completed forms directly with the selected authorized body. Typically, the price for a technical passport of housing varies from 600 to 2,000 rubles. In some cases you have to pay more/less. Everything is purely individual.

Important: private intermediary companies produce technical passports for an increased fee.

How to get an updated registration certificate

Before updating the registration certificate, you should collect all available documentation for the house, conduct an inventory and obtain a copy of the technical documentation. First of all, you need to get a copy of it, and for this:

  • contact the executive regional body or organization that stores technical passports and other assessment documentation or the Bureau of Technical Inventory (BTI);
  • pay the fee for providing a duplicate of the TP;
  • get a copy.

The technical passport of the MKD is stored unchanged until the moment when redevelopment, reconstruction or other work is done in the house or its premises, which entails a change in the data contained in the TP.

To receive a copy, you must provide:

  • title documents for real estate;
  • statement;
  • organization details.

To update the data of the technical passport of the house, it is necessary to conduct an inspection, scheduled or unscheduled. If discrepancies are identified between the actual condition of the house and what is indicated in the existing TP, it should be updated. In this case, you need to submit an application to the BTI. Development occurs in several stages:

  • acceptance and processing of applications;
  • inclusion of a request in the schedule of initial inspections of MKD by specialists;
  • determining the number and time of inspection;
  • inventory;
  • development of a technical plan with amendments;
  • Preparation;
  • issuance of the document.

After receiving the updated technical passport, the management company adjusts and makes the necessary changes to the fee for the services provided. But it should be remembered that the Criminal Code itself does not have the right to update the technical passport data; this is handled exclusively by the Technical Inventory Bureau. Independently measuring the area and drawing up a survey report is not enough.

Inventory for receiving TP

Only specialized organizations of a state or municipal scale can carry out technical accounting of premises: single enterprises, bureaus, centers, departments and services. In addition to direct inventory acts, their activities also include issuing technical passports.

Previously, owners were required by law to conduct an inventory and determine whether the current condition of the house corresponds to the information specified in the registration certificate. But in 2009, the planned five-year inspections were canceled, and therefore many houses and their owners simply stopped carrying them out or the data was filled out inaccurately, as a result of which the technical passports for apartment buildings became outdated.

But it is necessary to carry out an inventory to identify inconsistencies with the current state of affairs and indicated in the passport; the management company can fill out and maintain the technical passport of the house, but the state is not authorized to independently change and enter current information.

Documents for issue

To be able to obtain a technical passport, a citizen will have to have with him:

  • passport;
  • title document for the territory;
  • statement;
  • receipt with paid duty.

If the document is requested by the parents of a minor child, they will need to supplement the corresponding list with the child’s birth or adoption certificate and the passports of both parents.

It is better to provide all the above statements along with copies. There is no need to have them certified by a notary or lawyer.

Important: if the applicant has a valid cadastral passport, it is recommended to take it with him.

Other statements

But the papers listed above are not exhaustive. Sometimes you have to correct the document being described, and not just order it. In this case, you will have to act according to the principles indicated above. The difference in operations lies only in terms of the packages of papers provided.

If for one reason or another it is necessary to change the data in the housing registration certificate, the person will need to take with him:

  • act and permission for redevelopment;
  • draft of a new apartment or house plan;
  • documents indicating the fact of a change of ownership of the territory.

As a rule, reissue and adjustment of technical passports in Russia are rarely required. Confirming the existence of compelling reasons for achieving your goals is easier than it seems. The main thing is to have a certain package of certificates with you along with their copies.

About reality

Technical passports are initially issued for an indefinite period. This means that you have to use old samples of papers when concluding transactions. But this statement is not entirely true:

  • Firstly, the data in technical passports is verified and updated once every 5 years. This means that it is better not to use old copies of the statement. At a minimum, the cost of the object is subject to change.
  • Secondly, the authorities requiring the relevant paper can decide for themselves how old technical passports can be used. Typically, the validity period of the corresponding paper varies from 14 to 30 days. It is better not to use older samples.
  • Thirdly, as soon as the owners or technical parameters of a territory change, old real estate passports become unusable. It's worth updating them as soon as possible. Otherwise, a person will not be able to carry out any housing transaction.

Technical passport of an apartment building. What information does it contain?

There are regulations that approve recommendations for the design and content of the MKD technical passport. You can get answers by reading:

  • with part 5 of article 19 of the Housing Code of the Russian Federation;
  • with Appendix 11 to the Instructions for accounting of housing stock, approved by Order of the Ministry of the Russian Federation for Land Policy, Construction and Housing and Communal Services dated 04.1998 N 37.

When commissioning a new building, the developer company is required to present a technical passport and transfers it either to the relevant department of the municipality or to the management company (MC), if one has been determined at that time. In fact, the acceptance of an apartment building begins with studying information about the property. The technical data sheet contains the following general information:

  • address and geographical location of the residential building;
  • construction period: from project approval to completion;
  • parameters: total area, number of entrances, floors, rooms;
  • availability of non-residential premises;
  • materials of walls, foundation, roofing, ceilings;
  • principle and characteristics of electricity, heat and water supply;
  • availability of metering devices;
  • energy efficiency class;
  • dimensions and features of the land plot in the local area.

If the house is an old building, the current management company should take care of obtaining a registration certificate. In this case, information about ongoing repairs or reconstruction of the building, if any, is additionally entered.
