What is a BTI certificate?

A BTI certificate is an official document issued at the request of the owner of a property or other interested party. The content of the certificates will depend on the purpose and subject of the request - from the inventory value of the object to a copy of the floor plan of the building.

Initially, BTI bodies were created to carry out inventory and accounting of capital construction projects. At different periods of time, the powers of BTI institutions included the following functions:

  • registration of ownership of real estate;

These powers were gradually limited, and with the introduction of the cadastral registration system, BTI institutions generally lost most of their previous functions. The preparation of technical and boundary documentation for real estate is carried out by cadastral engineers, who use BTI information on previously surveyed objects.

How do you receive documents from the BTI?

As you can see, without obtaining BTI documents, it is impossible to register ownership of any premises.

Deadline for receiving documents from the BTI

As we have already noted, only the owner of the property or his legal representative can obtain BTI documents. An exception is the situation of inheritance, in which case the request is made by a notary, since the heir is not yet the owner.

Please note that permission for redevelopment, reconstruction or re-equipment of premises is now issued by other services in Moscow:

All certificates are issued by BTI authorities on a paid basis.   • the certificate will be issued within the period specified when receiving the request, or sent by mail.

You can receive a certificate not only in person, but also through a representative. To do this, issue a power of attorney through a notary office and indicate as part of the authority the possibility of obtaining any certificates from the BTI.

  • Technical passport of a residential premises - issued if some type of reconstruction is planned in the housing. The passport must be renewed every five years.
  • A floor plan is a detailed plan of the premises, most often it comes along with a technical passport.
  • Explication - can be of several forms No. 22, and No. 25, depending on the place where the documents are submitted. Validity period from 1 to 5 years.
  • Inventory assessment documents are a determination of the cost of living space, taking into account its condition. The certificate is valid for no more than 1 month.
  • Registration data – indicates all persons registered at a specific address. Valid for no more than 1 month.
  • Land plot plan - issued for a period of up to 5 years.
  • Extracts of the following forms: No. 3, No. 5, No. 11. These forms characterize the dimensions of the premises, the use of the attic space, and the period of commissioning of the premises. The information is valid for 10 days.
  • Extracts from the technical passport - this document characterizes the building itself in which the residential premises are located. Valid for 12 months.
  • Extract from the BTI organization – the certificate is valid for 12 months.

An alternative to the BTI certificate is an extract from the Unified State Register of Real Estate

With the introduction of the cadastral registration system, all information about real estate is recorded in a single federal database - the Unified State Register of Real Estate. It is the USRN extract that is the only proper title document. Cadastral registration information is taken from technical and boundary plans prepared by a cadastral engineer.

If the object has undergone the cadastral registration procedure, information about it is included in the Unified State Register of Real Estate. This means that current and reliable data on the object of interest can be obtained not through the BTI authorities, but by requesting an extract from the Unified State Register of Real Estate. The BTI contains and issues, at the request of citizens, various accounting and technical data on all real estate objects in its area. But for an apartment purchase and sale transaction, it is enough for us to know about the following documents (certificates) from the BTI:

Apartment floor plan

The floor plan of an apartment (“floor plan”) is a drawing that represents the floor plan on which the apartment is located, including the plan of the apartment itself. Explication

An apartment explication is simply a table with a list of all premises located in the apartment (both residential and non-residential), indicating their areas. You can see how this looks in the same documents that contain the “floor plan” (see the link to them above).

As a rule, the explication is ordered along with the floor plan of the apartment.

Technical certificate

The technical passport of an apartment is a document on several pages that contains technical and address registration data. It includes a floor plan of the apartment, an explication and an address plan.

BTI certificate form 1-a

A BTI certificate in form 1-a is simply an extract from the Technical Data Sheet of the apartment, made on an approved form. It provides a brief technical description of the property, its functional purpose, address of the property, and information about the owner of the property.

Cadastral passport

The cadastral passport of an apartment is an extract from the State Real Estate Cadastre (GKN), containing information necessary for all types of registration actions with the apartment.

From 01/01/2013 Cadastral passports for registration purposes are issued ONLY by the Cadastral Chamber of Rosreestr (FGBU FKP ROSRESTRA for Moscow).

At the same time, local BTI can also issue Cadastral passports, but for other purposes, for example, to obtain various permits and approvals NOT related to registration actions.

Certificate of inventory value

A certificate of inventory value of an apartment is a certificate indicating the residual book value of the apartment, taking into account its current wear and tear. This conditional value has nothing to do with the market price of the apartment.

Certificate of address compliance

A certificate of address compliance is a certificate whose name speaks for itself. When renaming individual streets, numbers or building blocks, such a certificate may be required to match the actual postal address with the address registered in the database.

How legal is a BTI certificate in 2021?

In most cases, BTI certificates in 2018-1019 will be of an informational nature and cannot indicate the presence or absence of rights to real estate. Information from inventory files has legal force only when determining the value of an object for inheritance purposes; in other cases it is of an auxiliary nature.

Here are examples when obtaining certificates from the BTI will be important for legal relations:

  • if the courts are considering disputes about the rights to real estate registered before 01/01/2000;
  • if the enterprise conducts a technical inventory of objects for its own purposes;
  • if it is necessary to prepare design documentation to change the characteristics of an object that has not undergone cadastral registration.

Technically, there is no need to update your old apartment passport. This document has no legal force. If you need to obtain up-to-date and reliable information about the characteristics of your property, you need to contact a cadastral engineer.

Procedure for obtaining a certificate

The question of where to get a certificate of absence of real estate is asked by everyone who is faced with the need to carry out legally significant actions with real estate or the need to receive subsidies.

The registration of information about real estate is carried out by Rosreestr and the Bureau of Technical Inventory, so you should contact the territorial divisions of these government agencies to obtain such a certificate. Moreover, Rosreestr provides information about real estate objects registered after 1998. To issue a certificate of real estate registered before 1998, you should contact the BTI. Information on real estate objects registered throughout Russia is contained in the Unified State Register of Rights to Real Estate and is provided to the applicant when applying to the Federal Service for State Registration, Cadastre and Cartography (Rosreestr). You can also apply for such a document to the MFC or to the Internet portals of State Services and Rosreestr.

A certificate from the BTI about the absence or presence of property can be provided to both individuals and legal entities, as well as individual entrepreneurs and employees of courts, law enforcement and other government agencies. At the same time, such information can be provided to government employees upon official request.

A certificate of absence of property is provided upon application drawn up in the proper form. In this case, the person will need to submit the following package of documents to the employee of the receiving government agency:

  • Internal passport of a citizen or a person acting in the interests of an individual by proxy;
  • Power of attorney certified by a notary. This document is provided if an authorized representative applies for an extract on behalf of an individual;
  • The birth certificate of a person under the age of majority must be submitted to the parent or guardian/trustee acting on behalf and in the interests of the minor;
  • Marriage registration certificate (must be submitted for married citizens);
  • Certificate of title to inherited property (confirms the right of ownership of housing when received by inheritance);
  • Receipt for payment of state duty.

All of the above documents must be submitted to the receiving organization in original.

A certificate from the BTI about the presence or absence of property of the established type is filled out on a special form. It must be certified by the signature of the responsible person and the seal of the issuing authority. You should check the document you receive about the absence of real estate ownership for the following information:

How to get an up-to-date floor plan

Floor plans are used in project preparation and approval of redevelopment. Upon request to the BTI, you will receive a floor plan at the time of the last technical inventory (most likely, this period will exceed 10 years). In order to have an up-to-date floor plan in hand, it is necessary to carry out cadastral work if the object has not previously been registered with the cadastral register.

The production of an up-to-date floor plan is carried out by a cadastral engineer. To do this, measurements are taken in kind, and current USRN information on the object being surveyed or on neighboring objects is also used. If there is no information about the building in the Unified State Register of Real Estate, the cadastral engineer can use the technical documentation of the BTI, including the floor plan. All measurement results are recorded in text and graphic form of a technical plan.

Expert commentary . The current floor plan drawn up by a cadastral engineer may differ significantly from a similar BTI document. The fact is that the engineer uses high-precision inspection methods, while BTI institutions had measuring instruments and techniques with significant errors. Today the institution has 83 branches, over a thousand branches in the regions of Russia. The main goals of BTI activities can be considered:

  • formation of statistical accounting;
  • creation of a tax base, which serves as the basis for the assessment of taxes and fees by the Federal Tax Service.

  • branches in small regions. As a rule, they are located in cities with a population of up to 200 thousand people;
  • branches in small towns;
  • the so-called workshops of utility companies;
  • various representative offices;

It is worth noting that this company does not receive any subsidies or other financial government assistance, so it is forced to rely only on its own income.

For this reason, the number of hired staff and the number of branches varies by region:

  • in Moscow the structure has more than 1 thousand hired workers;
  • in sparsely populated cities - the number on average varies from 5 to 10 workers;
  • In densely populated cities, there is often a so-called organizational form - MUP BTI (municipal company), which employs about 800 people.

Often, BTI carries out its labor activities as a branch or a state company - a federal state unitary enterprise (GUP).

Such fragmentation in form can only be explained by the fact that there is no need to maintain huge branches with a considerable number of hired workers in sparsely populated cities, where the volume of real estate, including transactions with them, is small.

Based on this, the company’s self-sufficiency forces it to organize its work activities in such a way that it brings economically justified benefits and justifies financial expenses.
