Who collects and stores data

There are two variants of the name, an extract from the Unified State Register or Unified State Register, but this is the same organization. Since 2021, the Unified State Register has been combined with cadastral information. The organization became known as EGRN. An extract from the Unified State Register of Real Estate helps in resolving disputes and guarantees the transparency of transactions with houses, apartments, dachas and other real estate. The Unified State Register of Real Estate stores all information that is somehow related to real estate. For example:

  • transactions related to the transfer of ownership rights to another person;
  • cadastral value of housing and assigned number;
  • information about the seizure of real estate;
  • information about the use of housing as collateral.

Any citizen can submit a request to receive data stored in the Unified State Register. The information is generally publicly available and can be provided to the applicant. But some of the data that is prescribed in the legislation of the Russian Federation can only be issued to a limited number of persons. This mainly concerns personal data and personal information.

Extracts may differ in content. They can be issued both on paper and in digital format. When preparing for a property purchase transaction, using information from the extract, you can make sure that the seller is not committing fraud.

Why is the Unified State Register needed?

Since 1998, everything that happened to real estate was recorded in the unified state register of rights. The most common situations when you may need to issue an extract:

  1. When living conditions improve. To do this, you need to register and submit a certificate of housing, which will serve as a guarantee of the need to improve the apartment.
  2. During the privatization procedure.
  3. When transferring housing as an inheritance. In this case, an extract helps to correctly draw up documents and transfer housing from the ownership of one person to the ownership of another.
  4. During legal disputes and proceedings. With the help of a document, you can easily identify the real owner of the property and expose the fraudster.
  5. When buying or selling real estate. The extract confirms the rights to the property of the seller.
  6. When registering an object as collateral when receiving a loan. The bank will require an extract from the Unified State Register of Real Estate as confirmation that the borrower is indeed the owner of the apartment or house.

Why and for what purpose is an extract from the Unified State Register needed?

Every tenth real estate transaction involves deception of buyers. Fraudsters falsify documents, sell apartments in buildings for demolition, or pass off housing as their own. What data is reflected in the statement?

The statement of ownership of real estate contains the following basic information:

  • personal data of all owners of the property;
  • date of registration of ownership rights;
  • real estate encumbrances, arrest;
  • cadastral data;
  • type of ownership;
  • area, number of floors;
  • apartment or house plan;
  • transfer of ownership from one person to another;
  • recipient of the statement;
  • date of receipt of the certificate.

Each document from the Unified State Register mentions the responsibility of those citizens who use information from the extract for personal gain or cause harm to property owners.

New law on real estate registration

As we have already written, the Unified State Register of Real Estate will combine two existing registers, which contain all the information about real estate in the Russian Federation.

The new law also introduces new registration procedures. It will apply more to the procedure itself, and not to the list of documents required to complete it.

Thus, registration of rights with the adoption of a new law takes 7 working days. Cadastral registration – 5 working days. And if previously the owner performed these procedures exclusively one by one, then from January 1, 2021, these processes can be combined into one. In this case, the total period will not exceed 12 working days.

You can receive an extract from the Unified State Register in several ways:

  1. At the Rosreestr branch at your place of residence.
  2. In the MFC department.
  3. On the official website of Rosreestr.
  4. Through the mediation of the State Services portal.

In order to receive an extract from the Unified State Register of Real Estate, you need to provide employees with the necessary set of papers. What documents the applicant needs can be found on the website. But most often the following list is required:

  • citizenship of the Russian Federation;
  • application completed according to the form;
  • title documents;

  • power of attorney, if the certificate is ordered not by the applicant, but by an authorized representative.

With the entry into force of the new Federal Law No. 218, the need to complete two consecutive registration procedures will no longer be necessary. The Unified State Register and the cadastre have been replaced by a new register - the Unified State Register of Real Estate, which will reflect information about objects, both by cadastre and by rights to them.

Until January 1, 2021, the technical characteristics of real estate were contained in the state cadastre, which has been maintained by the Cadastral Chamber (a structure of Rosreestr) since 2013. She received this function from the bodies of the BTI Rostekhinventarizatsiya. Registration of rights was carried out by branches of Rosreestr - UFRS in city districts and regions.

If you needed to register a new property, then first you had to register it with the Cadastre (by preparing a technical plan and filling out a declaration), and then register your rights in another division of the Federal Registration Service for registration of rights by submitting documents to the multifunctional center.

The period for cadastral registration was 10 working days, regardless of the type of registration actions, the period for registering rights was 10 working days. To this deadline it was necessary to add the time for sending documents from the MFC to government agencies. This time was unregulated and could be from 4 to 10 days. It was faster to submit documents for registration through the electronic functionality of the Internet, but in this case it was difficult for an unprepared user to understand the procedure for preparing documents, an electronic signature and a power of attorney for a representative suitable for this procedure.

Also, the existence of two registers could be traced on the official website of Rosreestr, where online you viewed information about the object - according to the cadastre and the Unified State Register. Lately, we have encountered a large number of errors that are caused, for example, by the presence of an object and its copyright holders in the Unified State Register and the lack of information about it in the Cadastre.

The way out of this situation can be different. According to the law and sound logic, it is necessary to record a previously registered object, however, in various territorial departments of the Cadastral Chamber they “recommended” to eliminate such discrepancies in different ways.

The new Law No. 218 “On State Registration of Real Estate” provides for the maintenance of a unified register, which, accordingly, will lead to a uniform approach to the registration of real estate.

You can request a certificate for a real estate transaction remotely through the State Services portal or on the Rosreestr website. To order a document, you must fill out an online application, indicate in it information about the property and information about the owner. And also choose how the certificate will be received. If this is an email, please indicate the email address.

After this, pay for the service non-cash - using a bank card or money from an electronic wallet. Please note that you will not be able to issue an extract directly on the State Services portal. The site only offers instructions on how to obtain the document, and then redirects to the official Rosreestr page.

The extract is sent in electronic format as an archived file. In the certificate sent online, the Unified State Register must affix an electronic signature, so the document has the same legal force as the paper version.

Registration in person

When applying in person to Rosreestr or MFC, submitting an application for an extract consists of several stages:

A citizen who submits a request to obtain information about real estate may be refused for several reasons:

  • the application does not contain the applicant’s signature or the text contains errors;
  • the document contains false information;
  • the method for obtaining the certificate is not specified;
  • a request has been submitted for information that relates to extradition to a limited number of persons.

If you need information that is classified as restricted, you will have to present a document that confirms your right to receive this data.

If the organization does not have the information for which the request has been submitted, or the data cannot be provided due to the lack of rights to receive it, the registration authority will send a notification of refusal to issue an extract from the Unified State Register within 3 working days.

If the extract is needed urgently, you can indicate this when filling out the document. In this case, the time for receiving an extract is reduced to 1 day. The validity period of the received document is 1 calendar month.
