Gaining access to the portal

You can access the Rosreestr Internet resource through the State Services website. To do this, the user will need to provide the following information:

The procedure for state registration of rights to real estate objects is regulated by Federal Law dated July 13, 2015 N2 218-FZ “On State Registration of Real Estate” (hereinafter referred to as the Registration Law).

In accordance with paragraph 22 of Art. 333.33 of the Tax Code of the Russian Federation for state registration of rights, restrictions (encumbrances) of rights to real estate, a state fee of 2,000 rubles is charged. When providing services for registration of rights in electronic form, the amount of state duty for individuals is reduced by 30% and amounts to 1,400 rubles.

Payment of the state fee for state registration of rights when submitting an application electronically is carried out after submitting the application and receiving from Rosreestr information about its accrual, containing, among other things, a unique accrual identifier (UIN). When making a payment, the UIN must be indicated. I always begin my inspection of the apartment for legal purity by studying these extracts. An extract about the property will tell you about: who owns the apartment; when the ownership was registered; information about encumbrances; apartment plan (not always); floor plan (not always), etc. An extract on the transfer of rights will tell you about: who owned and who owns the apartment; on the basis of what transactions the apartment became the property (for example, if the apartment was purchased, then the basis agreement will show the purchase and sale agreement).

The first extract shows that a certain Samkhina has owned the apartment since 2013, but the apartment has been under arrest since 2012. If an encumbrance is placed on the apartment, then transactions with it will not be registered in Rosreestr. It is rare, but it happens that the owners themselves do not know about the encumbrances on their apartment. They show their old certificates of ownership without a note of encumbrance and are sure that everything is in order with their apartment. And then, with the help of an extract, it turns out that the apartment, for example, is under arrest. Consequently, it will not be possible to buy such an apartment until the owners remove the encumbrance. Now about the statement of transfer of rights. If you see a frequent change of owners in the statement, then I strongly advise you not to buy such an apartment. Frequent changes of owners are usually used by scammers to hide some kind of scam. For example, scammers used a fake power of attorney to donate an apartment to a dummy. A few days later there is again a transaction of donation to another figurehead, and after that there is a transaction of purchase and sale. A chain of transactions is more difficult to challenge in court, because one of them may be completely legal. For example, when an apartment was bought by ordinary citizens who found themselves victims of such a fraudulent scheme. Therefore, do not mess with such apartments.

The extract from the sample shows that the first owner was a certain Kunashova, and she immediately sold the apartment to Chvanova (the date of registration of the right and the date of transfer of the right are the same day - 05/14/2003). After 2 months, Chvanova sold the apartment to Samokhina (date of transfer of rights - 07/15/2003). Samokhina sold the apartment on October 17, 2011 to a certain Kudryashov, who a few months later (02/20/2012) sold the apartment to a certain Lantsov. And then, by a court decision on August 23, 2013, Samokhina, who previously owned it from July 15, 2003 to October 17, 2011, again became the owner of the apartment (I painted over the first and middle names, they match in the extract). Personally, I would not get involved with such an apartment, even if the owner removed the encumbrance and it was possible to formalize the sale and purchase.
