Housing legislation obliges every citizen to promptly pay for housing and communal services (Article 153 of the Housing Code of the Russian Federation). Those who ignore this instruction and deliberately do not spend money on electricity, water, gas, and heat in their own home will face unpleasant legal consequences. The absence of a document confirming the proper fulfillment of obligations to resource-supplying organizations is grounds for prohibiting a citizen from traveling abroad or making transactions with his own apartment. These restrictions can be lifted only if the owner of the residential apartment provides a certificate of absence of rent arrears.

Where can I get a certificate of no rent arrears?

Each service provides for the issuance of an individual form for a certificate of absence of rent arrears (with the exception of residents of the capital's metropolis and Moscow Region, who can receive a single form containing financial statements for the consumption of gas, water, heat, electricity, and major repairs).

Pay using the mobile application

After downloading it, the client must:

Having entered his personal account, the client first needs to add his personal account.

He must:

Now he needs to answer the security question and click on the “Confirm” tab.

To make a payment, the user needs to go to his personal page.

Who is the certificate issued to?

The need to obtain a certificate of no debt may arise from:

  • home owner;
  • authorized representatives of the property owner;
  • residents who have permanent residence in the property;
  • employees of guardianship and trusteeship authorities;
  • employees of the bailiff service, representatives of supervisory (controlling) government agencies.

At the time of applying for the document, the applicant must have reached the age of majority (18 years).

Attention

An agreement on the provision of housing and communal services may include a provision on the confidentiality of information contained in it. In this case, the circle of persons who are allowed to receive a certificate of debt for housing and communal services is narrowed to the owner of the apartment/house and representatives of law enforcement agencies (police, prosecutor's office, court).

Validity

As a rule, the validity period of a certificate confirming the presence or absence of debts for housing and communal services is set to 10 days. This period of validity is not fixed by law, but is accepted in most organizations.

Usually, the contract for the provision of services, as well as the Housing Code, states that payment must be made no later than the 10th of each month. Thus, the certificate must be valid for at least a calendar month. However, organizations requiring a certificate may have special requirements for the relevance of the data.

The ten-day validity period is explained by the fact that in 10-15 days account balances are updated and debt increases for the current month.

It is advisable to receive the certificate in hand immediately before completing the documents or concluding a purchase and sale agreement, so that its validity and the relevance of the specified information do not expire.

If issuing a loan or processing documents for departure is delayed, you will need to obtain a certificate again. It should be noted that some organizations, for example, HOAs, relying on the norm of the Housing Code, indicate that the certificate should be issued only for a calendar month. The applicant may be refused to issue a second certificate. To quickly find a common language and remove all claims, we recommend that you obtain a copy of the requirements for issuing a loan or requirements for receiving other services. They must contain a link stating that the certificate is valid for 10 days. This will help argue for the need to re-issue it.

As another option, write a letter and officially register it, indicating the information that the certificate was submitted upon request, however, it must be updated. Refer to the norm of the contract. Most contract texts contain a clause that states that the consumer has the right to receive information about payments in a convenient form, and at any time, at his personal request.

When is a document confirming the absence of financial claims necessary?


A certificate of no rent arrears may be required if:

  • making real estate transactions (when buying an apartment or house, the new owner must make sure that he is purchasing the property without debt);
  • obtaining a secured loan (when considering the issue of providing a mortgage, a bank employee must verify the financial reliability of the borrower);
  • receiving subsidies from the state (for families with a low level of material well-being, the authorities partially compensate for the costs of housing and communal services; when applying for a subsidy, the homeowner must confirm the timely payment of payments for electricity, gas, water, heat);
  • division of common joint property (when divorcing a marriage, spouses must remember that they bear joint responsibility for paying utility bills);
  • crossing the state border (travel abroad is prohibited for those who have unpaid receipts for electricity, water, gas, heat);
  • housing privatization;
  • accepting Russian citizenship;
  • investing money in a real estate property (when buying a shopping complex or other commercial premises, the new owner has the right to demand that the seller have no debts on housing and communal services).

Please note:
A request for a certificate of absence of debts for housing and communal services may also come from the guardianship and trusteeship authorities. Government officials must be sure in advance that the person wishing to adopt a child is financially secure.

Before purchasing a home, the new owner has the right to demand from the seller not only a document confirming the absence of rent debts, but also a document confirming the absence of debts on contributions for major repairs. Otherwise, the deal may not take place.

How to order a certificate?

A tax debt certificate is issued by the tax office at the place of last registration of an individual. To receive it you must submit an application.

It can be done:

  • by visiting the tax office in person;
  • by sending an application by mail;
  • online by registering on the Federal Tax Service website.

When submitting an application online, you must indicate in what form you would like to receive the certificates: on paper or electronically. The certificate is sent in electronic form to the email address specified by the applicant and is available for downloading or sending to other recipients within 5 days. It is certified by an electronic digital signature and has the same legal force as a paper document. But some institutions insist on submitting a certificate confirming the absence of debts, exclusively on paper.

Documents to be received

To obtain a certificate of absence of rent arrears, the following must be provided to the HOA (Management Company, Housing Office, Unified Center) for obtaining a certificate of absence of rent arrears:

  • identification document;
  • power of attorney (if the document is requested by an attorney);
  • a document confirming ownership of the apartment (“pink certificate”);
  • apartment/house purchase and sale agreement;
  • housing order/social tenancy agreement;
  • readings from individual metering devices for electricity, heat, water and gas;
  • receipts for timely payment of utilities.

A certificate of no rent arrears is issued on the day of application or within 2-3 days after submitting the necessary documents. The applicant should check on site the relevance and correctness of the information specified in the document. The slightest typo or inaccuracy can slow down the process of completing a transaction for the alienation of an apartment or house.

How does debt disconnection work?

A citizen who, for any reason, cannot pay off his electricity debt on time may face a power outage.

The energy supply company has the right to turn off electricity in the following cases:

  1. By agreement with the consumer.
  2. By order of Rospotrebnadzor.
  3. Due to the liquidation of the accident.
  4. To carry out scheduled technical work. However, they should not last more than 72 hours per year and no more than 24 hours at a time. At the same time, residents must be warned in advance about planned technical work.
  5. If there is a debt for 2 months or more.

It is impossible to carry out a power outage if an accident could occur as a result.

Shutting off power supply for debts is applied in the following order:

  1. Before disconnection, residents must be notified in writing, against signature, or by registered mail.
  2. After notification, you are given 20 days to repay the debt.
  3. During this time, the supplier has the right to partially limit the supply of electricity.

If debtors do not repay the debt during this time, they receive another notice. After 3 days, the energy supplying organization has the right to suspend the supply of electricity.

You can reconnect the power supply if you pay the debt in full. If it is impossible to repay the debt in full, you can contact the resource supply company with a request for an installment plan. If an electricity supplier violates the rights of subscribers, they can file a complaint with the housing inspectorate, the prosecutor's office or the court.

Step-by-step instruction

At the initial stage, the interested party collects a package of necessary documents and submits them to an institution that is authorized to issue certificates of absence of debts for housing and communal services. If employees recognize that the information provided by the applicant is comprehensive, then it is entered into the database and a certificate is issued directly on the day of application.

If there is outdated data on the personal account (inconsistency in the number of people living in the apartment, the size of the area of ​​the house, etc.), the applicant may be required to correct the deficiencies, which leads to an increase in the period for issuing the certificate (up to 3-4 days).

Using the online pre-registration option on the Unified Settlement Center website significantly simplifies and speeds up the process of obtaining a document proving the absence of financial claims from utility service providers.

Debt check at Mosenergosbyt

There are several options for checking utility debt. The simplest thing is to personally visit the Mosenergosbyt office. You can also find out the debt online on your personal account in your Mosenergosbyt personal account using a smartphone or computer.

By personal account number

The payer's personal account is a combination of numbers that is an identifier of a specific residential premises. You can find out your personal account from the receipt that comes for utilities, from the management company (TSN) or on the portal to State Services.

At the apartment address

You can check whether there is a debt at the apartment address by coming to the Mosenergosbyt office and giving the address of the property. You must take documents with you to confirm the identity of the apartment owner and ownership. Afterwards, the specialist will provide information about the presence or absence of debt.

By phone

You can find out if you have a debt by calling the Mosenergosbyt 24-hour hotline number +7 (499) 550-9-550. By phone, you must provide the employee with your personal account number and information about the owner of the property. Next, the specialist will provide the information of interest.

On the portal pgu.mos.ru

You can also find out about the debt for electrical energy to the supplier PJSC Mosenergosbyt on the Moscow government services portal pgu.mos.ru. You need to go to the section on receiving and transmitting electricity readings on the website and fill in your personal account number.

Here you can also find information about the period for transmitting readings and the date of verification of your meter. If you wish, you can view the archive with previously transmitted testimony for three years and the archive of payments. There is a print function.

Document form

There is no universal form for a certificate of absence of rent arrears. When drawing up this document, legal entities (homeowners' association, management company, housing office) are guided by local (internal) regulations. But the law requires that all certificates from organizations indicate:

  • Title of the document;
  • Full name of the owner/tenant of the property;
  • location of the property (address);
  • name of the company supplying the utility service;
  • indicators of individual metering devices for electricity, heat, water and gas.
  • amount of debt (in rubles);
  • personal account number of the house/apartment.

The document must be marked with the date, signature of the official and seal of the organization. A special certificate form is provided in the Unified Settlement Centers (EIRC-22).

Despite the absence of mandatory (imperative) requirements for document execution, some institutions may refuse to perform certain actions/provide services due to incompleteness of the information provided. The bank will not approve a mortgage loan if the potential borrower has presented a certificate of absence of debt with inaccurate (distorted) data.

What must be included in the application?

An application to the tax office for the issuance of a certificate confirming that an individual has no debt to the budget at the time of issuance must contain the following information:

  • last name, first name, patronymic, date of birth of the applicant;
  • number and series of the identity card, who issued it;
  • TIN;
  • place of registration.

The applicant can also indicate to which institution the certificate will be submitted. If such information is not available, it is issued at the place of request. The application must be accompanied by a copy of the TIN and passport with registration information.

Important! If the application does not contain the data required by law for an individual, tax specialists will refuse to issue a certificate confirming the absence of debts to the budget. If information about the debt needs to be submitted promptly, it is advisable to contact the company, whose employees have extensive experience in obtaining various documents from the tax office.

How quickly is it issued?

The legislation establishes a maximum period for consideration by tax service specialists of applications and issuing information about the absence or presence of debts to the budget of individuals and legal entities - 10 days.

If an application is submitted to indicate a tax debt or confirm its absence electronically, the document is usually sent to the email address of an individual or legal entity within 1 business day, but sometimes this period can increase to 10 days.

For individuals, as well as for legal entities and individual entrepreneurs, the service of urgent issuance of documents is offered after payment of the state fee. In this case, information about the debt will be ready within 1-3 business days.

If the application is sent by mail and the individual also asks to send him a document confirming the absence of overdue debt, then the period is extended by several more days.
