Where can I get a document on participation (non-participation)?

Certificates in Russia are issued by the Bureau of Technical Inventory, MFC, Rosreestr, in addition, citizens are given the opportunity to order a document through the State Services website.

The privatization participant must decide how long he needs the certificate.:

  1. BTI owns data for the period from 1991 to 1998 and issues a document called “certificate of the presence or absence of ownership of real estate.”
  2. Rosreestr and MFC provide documents that are called - a certificate of non-participation in privatization, with information for the period from 1998 to the present day.

Minor children in Russia have the right to participate in privatization twice - once before reaching adulthood and a second time after 18 years. They do not need to obtain the above certificate.

Validity and cost

As for the cost of this certificate, the Multifunctional Center and Rosreestr will issue it to the citizen completely free of charge. If a citizen contacts the BTI, then this service is paid and costs on average from 200 to 5,000 rubles, depending on the circumstances. Its cost differs depending on the region and the prices established in it for the preparation of documents.

If a citizen does not have the opportunity to prepare documentation, then he can do this through a proxy or through a real estate agency. If he uses the latter, he will have to pay for the services of a realtor.

As for the timing, on average, a certificate of non-participation in the apartment privatization procedure is issued in ten working days.

Application methods

You can submit an application both at the branch and remotely, depending on the authority issuing the paper. You should go to the BTI in person, and Rosreestr accepts applications :

  • in regional divisions;
  • through legal representatives;
  • by mail;
  • via email.

By default, the applicant is sent a certificate through the same channel through which the documents and application were previously sent. For example, a citizen who has used the services of an MFC near his home will be able to go there for a completed certificate, while a Russian who has sent a letter by mail should look in his mailbox while waiting for an answer.

What is the price?

The cost of the service for issuing a certificate depends on where exactly it is done. Local administrations provide this service free of charge. If a citizen has not changed his place of residence since 1991, then all the necessary information is at the disposal of the department or department dealing with real estate issues.

A certificate for the period 1991-98 obtained from the BTI is most often paid for. However, the cost of its production is low, about 200 rubles. You will have to wait the required 10 days by law.

For urgency, BTI will charge an additional fee.

The most expensive is a certificate from Rosreestr. Its cost depends on the number of real estate properties owned by the applicant. In different regions, the price of such a service ranges from 500 to 2000 rubles.

How to get paper through State Services?

The most popular way to obtain certificates these days has become ordering documents through the State Services website. It makes it possible to fill out an application without leaving home and provide a package of necessary papers with minimal time investment. Recipients of the service are only individuals participating in privatization. Their legal representatives can also order a certificate by power of attorney.

Application Form

To complete the application you must:

  1. First of all, a citizen must log in to his personal account.
  2. Then go to the “Public Services” section.
  3. The fastest way to find the desired option is through a search, enter in the appropriate line: “about non-participation in privatization” and click on “search”.
  4. A form will appear on the screen that needs to be filled out, as well as a list of documents - they should be uploaded to your personal account.

What documents are needed?

  1. Application for issuance of a certificate of participation in privatization. It is a mandatory document and must be completed by hand or typewritten.

Terms of service provision

A citizen will be able to receive a completed certificate 10 days after completing the application. This review period consists of the following periods:

  • registration – 1 day;
  • review of provided papers - from 1 to 4 working days (in some cases, employees require additional verification, so the decision not to provide the service is usually not made immediately);
  • establishing contact with authorities that have the necessary information – 3 days;
  • The state will need another 3 days to sign, register the certificate and send it to the applicant.

Procedure

Privatization occurs in several stages:

  1. The first of them, the longest and most responsible, is the preparation of the necessary package of information. Many documents have to be prepared, and this takes some time. Therefore, it is worth starting preparations for privatization in advance.
  2. The second stage is checking the submitted application and all information attached to it. It takes from one to 3-4 months. The length of the wait depends on the number of citizens wishing to privatize their apartments during the same period.
  3. The final stage is the signing of the contract and registration of ownership. This will require the presence of all participants in the privatization or a proxy with appropriate confirmation of his authority.

Required documents

The list of documents that will be required for privatization must be clarified in advance with the local administration. It is also worth remembering that many information has a limited validity period.

If the application is delayed, they will have to be taken again. Copies of some documents will require notarization.

  • an application, the form of which is obtained from the administration and filled out for each of their participants, including minors;
  • passports and birth certificates of all participants;
  • certificates of marriage and its dissolution (if the surname has changed);
  • technical and cadastral passports for the apartment;
  • social tenancy agreement or order for an apartment;

  • an extract from the personal account confirming the correct receipt of utility bills;
  • refusal of privatization if there are residents who do not want to participate, certified by a notary;

When can they refuse?

During the application review process, the state may refuse to provide the service. There are only a few reasons that may be grounds for refusal. And in each case, the citizen has the right to apply again, correcting the mistakes.

  1. The application was submitted by an inappropriate person .
    If the administration does not have information about the participation of the person who requested the certificate in the privatization of the housing stock, the provision of the service will be refused. The citizen should double-check his documents - perhaps he applied for the certificate too early and should wait until the city hall staff receives the information.
  2. Inconsistency of submitted documents . It is quite rare for people who submit an application through the State Services website to be rejected with the above wording - but this also happens. If the documents uploaded to your personal account contain pencil entries, corrections, crossed out words, or corrections using a proofreader, the documents will not be accepted. It is also worth making sure that all papers are readable, without damage, and that their contents can be easily deciphered. This wording means that the applicant should replace the scanned copies and re-file the application to obtain a certificate from Rosreestr.
  3. The authority of the representative has not been confirmed . As we have already written, not only the citizen himself has the right to submit documents for obtaining a certificate, but also his legal representative - a parent, guardian or a person with a notarized power of attorney. If during the application process a scanned copy of the power of attorney was not uploaded, and the information is requested by to a third party - the citizen will receive a refusal with the above wording. When applying again through the form on the State Services website, you should make sure in advance that you have a power of attorney certified by a notary.
  4. The application was not completed properly .
    If errors are made in the application that do not allow the subject of the information requested by the applicant to be established, the certificate will not be issued. Incorrectly entered data of a citizen in the form can also become a reason for refusal.

Where is the privatization refusal kept?

“Let’s simplify the task, do you work somewhere with the registration of labor? So you have an open-ended contract with this employer, are you his slave for life? How should you quit? Is the application enough? They will return, do you think the right remains? When deregistering, an application is written; this action is necessary and certified by the head of the Federal Migration Service. If this is not confirmed, then all Russians are questionable; these authorized ones actually issue us passports.”

In accordance with Part 1 of Article 558 of the Civil Code of the Russian Federation, a list of persons who, in accordance with the law, retain the right to use residential premises after its acquisition by the buyer, indicating their rights to use the residential premises being sold, is an essential condition of the contract for the sale of a residential building, apartment, part of a residential building or apartment in which these persons live.

At the same time, from a general sense, refusal of privatization should be understood as a duly certified voluntary expression of the will of a person who has the right to participate in privatization and gives consent to its implementation, to refuse to register ownership of a residential premises.

  • a document confirming the change of the surname, and (or) first name, and (or) patronymic of the Applicant - certificates (certificates) of state registration of acts of civil status on marriage, divorce, change of name (if the Applicant changes the specified data after the conclusion of the agreement privatization, a copy of which (or copies of the documents that served as the basis for the conclusion of which) is requested; in the event that the specified data in the Applicant’s identity document differs from the data contained in the documents submitted by him.

6. Grounds for refusal to provide public services:

a) failure by the Applicant to provide the necessary documents; b) expiration during the period of provision of the Municipal service of the document submitted by the Applicant, and (or) revocation of the power of attorney, and (or) cancellation of the act of the guardianship and trusteeship authority establishing guardianship (trusteeship); c) non-compliance (in form and (or) content) of the documents submitted by the Applicant with the requirements of the current legislation; d) the absence in the Application for the issuance of a certificate of complete data (last name, first name, patronymic, date of birth) about the person whose participation in the privatization of residential premises must be confirmed or refuted; e) request by the Applicant for copies of documents that do not affect his rights and freedoms (at the time of privatization, the Applicant did not have the right to use the residential premises, copies of documents for the privatization of which are requested); f) absence of the original agreement in the Committee’s storage (the residential privatization agreement was not registered with the Committee); g) the presence of a written objection from a third party, in whose interests the application was submitted, regarding its consideration.
