Where is the registration address in the passport?

A citizen's passport in Russia is the official and most necessary document.

In it you can find all the information about the person: his name, where he was born, whether he is married or not, how many children he has, in which military unit he served and, of course, where he lives.

Many of these entries are not entirely mandatory; more precisely, they may not be contained in the passport. For example, a person may have children, but this may not be noted in the passport. Is it possible to do this with all records, in particular with registration at the place of residence? Let's figure out how mandatory a registration record is, and what happens if it is missing. Also in the article you can find examples of a passport page with a photo of a registration stamp.

Is it necessary to mark the registration address at the place of residence?

The registration address at the place of residence, as well as at the place of stay, must be indicated in the passport. Paragraph 5 of the Decree of the Government of the Russian Federation “On approval of the Regulations on the passport of a citizen of the Russian Federation...” provides a list of information that must be indicated in it. Nothing is said about the mandatory nature of this requirement, as well as about the possible consequences. It only says that violation of requirements entails liability.

If we talk about liability for the absence of specified information in the passport, it is worth noting that it is provided for in the articles

19.15.1.

And

19.15.2. Code of Administrative Offenses

.

They say that residence of a person at the place of residence or place of stay without a registration mark beyond the permitted time shall entail the imposition of an administrative fine, which amounts to 2-5 thousand rubles for individuals, for legal entities 250-750 thousand rubles.

For Moscow and St. Petersburg, these fines are slightly higher.

In addition, registration provides many opportunities , for example, to freely visit a local clinic, stay in a hospital, attend a preschool institution, receive social services, etc.
In practice, citizens are registered from birth, and when the first passport is issued, it usually already contains an entry.

At the passport office, if a citizen wishes to deregister at his place of residence, he may be refused if he does not provide a new address at which he will be registered in the future. They are also almost always registered at the place of residence, for example, if you study or are employed in another city and live in a dormitory, then the head of the dormitory also registers everyone . Therefore, it is possible to remain without a registration mark in rare cases. Registering yourself at your place of residence is simply vital!

Registration address

In the Russian Federation, there is a concept of permanent registration at the place of residence, which for the citizen himself is a stamp in the passport with the address of permanent residence. Also, permanent registration is sometimes called a residence permit, and in order to obtain it, you must contact the territorial body of the Federal Migration Service with the appropriate application and documents confirming the right to reside at a given address. From a legal point of view, registration at the place of residence is a notification to the state that a given person permanently resides at a certain address. Moreover, if a person lives at the address that is the place of his permanent registration, we can say that his registration address and residential address are the same. In turn, it is precisely this situation that underlies the state planning system, which makes it possible to create the required number of schools, kindergartens, launch the required number of public transport units and form other infrastructure necessary for the normal functioning of a populated area. In this regard, registration at the place of residence is mandatory, and for living without registration a citizen may be subject to a fine. In accordance with Article 19.15.1 of the Code of Administrative Offenses of the Russian Federation, the amount of such a fine can range from 2 to 3 thousand rubles.

How long does it take to register in a passport?

The law “On the right of citizens of the Russian Federation to freedom of movement...” strictly specifies the time during which entries must be completed. How long does it take to register? In Art. 5, 6 of the law on the right of citizens to freedom of movement states that the state body must register at the place of residence or stay within 3 days from the moment it receives documents from the citizen. List of documents:

  • passport;
  • statement;
  • a document that is the basis for moving into housing.

In some cases, when it becomes necessary to send a request to government authorities to confirm information about the right to use residential premises, this period can be extended to 8 days.

The accounting authorities have the right to seize the passport in order to put the appropriate mark on it, but at the time of registration they must issue a certificate stating that the original document was seized for such and such actions.

Now you know how long it takes for a citizen’s passport to be taken away in order to fill out the registration page.

The main differences between the terms “place of residence” and “place of stay”

Taking into account the above, we can draw conclusions about the main differences characterizing the concepts of “place of residence” and “place of registration”:

  • duration of stay;
  • grounds for moving in;
  • type of accommodation facility;
  • completed documents to confirm the fact of residence;
  • responsibility for registration;
  • the scope of civil rights to which a citizen has access.

We see that how long a person stays in the premises and what rights he has to this living space determine the key difference between the place of stay and the place of residence.

Let's also say a few words about documents that confirm the fact and method of registration of a person at a certain location.

The address of the “place of residence” is most often formalized as “permanent registration” and looks like:

  • as a stamp in a passport (for adults and children over 14 years old);
  • as evidence - Form No. 8 of the Ministry of Internal Affairs of the Russian Federation for the provision of state services for registration (Order of the Ministry of Internal Affairs of Russia dated December 31, 2017 No. 984) - for children under 14 years of age who do not yet have a passport;
  • as a mark - Appendix No. 4 of the Ministry of Internal Affairs of the Russian Federation (Order of the Ministry of Internal Affairs of Russia dated November 23, 2017 No. 881) - for foreign citizens, etc.

When listing how the place of residence differs from the place of stay, it is worth mentioning documents to confirm temporary location as another differentiating aspect. After all, the fact of registration at a temporary address is confirmed solely by a certificate. Its variety is also different - form No. 3 is used. Documents according to form No. 3 and No. 8 are issued in person upon registration of the fact of “moving into” the premises and are issued individually to the citizen. The fact of registration is also confirmed by a registration certificate in Form No. 9; it is ordered additionally and contains information not about one citizen, but about all those registered in a given apartment (house).

Speaking about a person’s civil rights and his access to public services (education, medicine, etc.) at his place of residence or place of stay, it will be useful to know the following:

  • all rights are exercised at the place of primary residence;
  • in case of temporary registration, access to public services is limited to the period for which the certificate was issued.

If the information is incorrect or entered with errors

As you know, an identity document with corrections, errors or incorrect data is invalid. Therefore, if the registration information was entered incorrectly by an employee, then under no circumstances should you correct it yourself. To do this, you should immediately go to the migration service department with an application for a replacement.

Registration in a passport at the place of residence or stay is necessary in both cases. It's important to do it. Properly executed documents provide a citizen with many rights, and also relieve them of legal penalties in the form of fines. In this connection, the accounting procedure must always be carried out in a timely manner and in compliance with all rules and laws.

Not all questions are clear when it comes to residence registration. For example, how can I make a note about this in my passport?

Are migration service officers acting legally when they take away the original passport?

And at what registration do they put a mark - permanent or temporary?

When do you mark it?

Do you need registration in your passport?
All registration procedures for both types of registrations are regulated by the same legislative act - Order of the Federal Migration Service of the Russian Federation dated September 11, 2012 N 288, which approved the Administrative Regulations for the provision of accounting services by the Federal Migration Service. However, some services relate to changes in the main identity document , while others do not.

  1. When registering at your place of residence : clause 18 Admin. The regulations state that the result of permanent registration for adult citizens is the imprint of a special stamp in the passport.
  2. When registering at your place of stay : in paragraph 56 Admin. The regulations indicate that temporary registration does not require the cancellation of permanent registration, that is, the stamp in a person’s passport remains for the entire period of his absence from home. Having successfully completed the accounting procedures at the point of non-permanent location, on the basis of clause 18 of the Admin. regulations, he will receive as a result a certificate of registration at the place of residence.

Registration and residence address: the difference

People today are very mobile; moving from one place to another is not a problem at all. It takes a person hardly more than 2 days to do everything. For this reason, the address of registration and residence may differ from each other, and the description of each of them is worth knowing.

Registration

Dear readers! The articles contain solutions to common problems. Our lawyers will help you find the answer to your personal question free of charge. To solve your problem, call: You can also get a free consultation online.

In our country there is the concept of permanent registration, it is also called registration. This is a stamp in a passport that shows exactly where a person lives. To obtain such a stamp, you must contact the passport office, MFC, or Ministry of Internal Affairs with a package of documents that are the basis for registration and will help you obtain it. It can be:

  1. Certificate of ownership, if a person registers in his own apartment or house.
  2. Permission of the owner, co-owners, if in someone else's.

If we consider the registration address from a legal point of view, then this is an information tool that helps the state track the place of residence of each person on the territory of the Russian Federation and provide each resident with the necessary conditions.

If a person does not travel anywhere and lives in the same place where he is registered, then his residential address and registration are the same. It is such information by all citizens that makes it possible to plan the number of places in schools and kindergartens, and to release the required number of public transport units on the route. That is, to do everything so that the registered population feels comfortable within a particular locality.

Important! It is to ensure full access to all the opportunities of a particular city of the Russian Federation that registration is mandatory; in its absence, a fine is imposed on a citizen of the federation or a migrant.

Accommodation

The address of actual residence does not always coincide with the registered address. According to the law, if these two places are located in the same city, then there is no need to deregister and register. For the reasons described above.

If a person moves to another region or region of the Russian Federation, then he is obliged to report his location. In this case, it is not necessary to register at the place of permanent registration. If your stay at another address does not exceed 90 days, then temporary registration is also not needed. If this period is more than 3 months, then it is worth finding a place where to register a temporary type. This could be the address:

  1. Relatives.
  2. Colleagues.
  3. Service apartment.

Residence at this address is required. If the apartment is someone else's, then permission for registration of the owner, owners, if there are several of them. It is worth considering the temporary registration carefully, because if it is proven that the person at the specified address does not live, the owner of the apartment will face a fine.

In addition to the fact that with registration at the place of residence one will not have to worry about problems with the law, a person gets the opportunity to enjoy all social benefits, including when going to a clinic.

Theoretically, you can live in another city without registration, but there may be problems with the law, even criminal liability. This situation often happens if a person goes to another region to earn money, but it’s still not worth the risk.

Registration period

How long does it take to register in a passport after it is taken?

The actual imprint of the stamp is the final touch in the procedure : the documents are checked, the information provided by the person registering is checked against the data in the file cabinets, and FMS specialists decide to give the green light for registration at the point of the citizen’s new permanent location.

After a positive decision , the law gives a period of 1 day to make entries about a new resident of the district in the registration cards, and after that - 3 minutes to put a stamp (clause 88 of the Administrative Regulations).

How many days does it take to collect the document to make the necessary mark? The main identification card will be taken at the time of receipt of the application for registration and other required papers, and will be returned after the entire procedure is completed. This period can range from 3 to 8 days .

What will they give in return?

Is it legal for someone to take away your passport?

Yes, its original is included in the exhaustive list of documents for the provision of registration services, both types (clauses 25, 26 of the Administrative Regulations).

What do you receive at the time of registration? When an employee of the Federal Migration Service, MFC or passport officer accepts papers for registration actions, he will write a receipt for the seizure of the original of this document.

From 3 days to a week you will have to refrain from visiting financial institutions and making serious transactions or purchases on credit.

If the case is complex and will require several weeks, then instead of the main permanent identification card they may be issued a temporary one with a photograph inserted. The validity period of such temporary paper is 1 month.

What does the stamp look like?

Where exactly do they put the mark? The stamp is applied to one of the pages reserved for such marks. These pages are numbered from 5th to 12th , on the 5th there is an inscription at the top and in.

On these seven pages, the FMS authorities must put down marks on registration and deregistration at the place of residence.

What should be included? The full name of the FMS unit performing the registration should be printed at the top, then “Registered” .

Below there is an empty line for entering the name of the locality, and a line for the address. At the bottom is the date of permanent registration and the signature of the official who carried out the procedure.

What to do if an error is detected?

What to do if the information in the stamp is incorrect or entered with errors ?

If an employee made a mistake and entered passport data into the stamp that does not correspond to reality , then you should immediately go to the Federal Migration Service with an application to replace the passport, since corrections in this main identity card are unacceptable .

To reduce problems, you should check all pages and all entries for correctness: migration officials are overloaded, so it is likely that the “human” factor , and a tired person, in exceptional cases, may make a mistake.

A discovered inaccuracy will cost no money if you write in the application that the reason for the replacement is a technical error, although it is clear that the paper was not damaged by the citizen himself.

After this, the information is entered into a new copy of the identity card.

The preparation of papers and especially the making of marks in the original documents require great attention and scrupulousness . Before you sign for your main papers, you need to check that everything is correct.

Since permanent registration is usually valid for many years and even decades, this registration procedure must be completed in a timely manner , in compliance with all laws and regulations. Only correctly executed documents make it possible to fully enjoy the rights of a citizen of the Russian Federation .

Dura Lex, Sed Lex!

Pages five to twelve of the passport form are intended for making notes on the citizen’s registration and deregistration at his place of residence. At the top of the fifth page with a centered orientation is the “Place of Residence” attribute.

A passport is considered the main document confirming the identity of a citizen of the Russian Federation. Everyone over 14 years old should have it.

All basic information is entered into it: full name, place and date of birth, gender, registration, marriage registration data, military service record, children. Some of this data is optional and is recorded only if, for example, the citizen has children or is married. The other part is considered mandatory. Such data includes information about registration (registration).

Difference of concepts

The need to record location is due to the observance of law and order and the performance of duties on the part of both citizens and the state. The Civil Code of the Russian Federation obliges people to register in their own interests. After all, if the actual population in a city does not coincide with the official number of people based on the census, this can lead to problems in the administrative, housing, electoral and other aspects of the law of such a region.

For example, unregistered citizens living in the city are legally unable to vote in elections. In medical institutions, the number of beds and medical personnel will also not correspond to the actual workload. This is why every citizen must indicate their location to the passport and visa service when moving to another region or city.

Unfortunately, not all residents show responsibility and come to the Department of Migration Affairs of the Ministry of Internal Affairs (the department for migration issues, which replaced the FMS) to register. And this is largely due to confusion in concepts.

Registration address (official registration) - permanent place of residence, which is placed on the fifth page of the passport in the form of a stamp. The Civil Code distinguishes three main terms relating to the dislocation of people and assigning it to certain territorial bodies:

  • registration address;
  • place of residence;
  • place of residence.

Often the address in passports does not coincide with the registration address where citizens live. In this case, the wording “place of residence” or “place of stay” is suitable. How to understand these concepts in practice? Let's give a few simple examples.

What is a place of registration

Legal registration of citizens is registration, which is indicated in the passport as permanent place of residence. As a rule, it is obtained as a result of the privatization of municipal apartments, when purchasing housing on the primary or secondary market. Most citizens receive initial registration in their parents' home. If a person does not move, then the address indicated in the passport coincides with the place of residence. In this case, the law requiring citizens to live at the place of registration (RF Government Decree No. 713) is observed.

Nuances of the concept of “place of residence”

When a person leaves the apartment or house in which he was originally registered, the new point of location is considered to be his place of residence. If a citizen settles at such an address, then he is obliged to record this fact by reporting this residential address to the territorial passport and visa service. For example, a girl got married or a young man got married and moved to live with his husband in another city. At the same time, he (she) cannot do without registering at a new location.

If a husband or wife registers their spouse in their apartment, then we will again be talking about official registration. To do this, it is necessary to deregister at the territorial office of the UMV at the place of residence by putting the appropriate stamp in the passport.

What is a place of residence

If a citizen moves to a different address due to the performance of official, military and other duties for a short period of time, then his deployment qualifies as a place of stay. This means a short-term change of place of residence, after which the person is expected to return to the address indicated during state registration as the main place of residence. For example, when sending employees to another city, the employing company temporarily rents apartments for their accommodation for 2 months. In this case, you need to register temporarily at the passport office.

Is it necessary to mark the registration address at the place of residence and why?

According to Decree of the President of the Russian Federation No. 232 of 03/13/1997, the main document has a certain approved form, into which all information about the citizen is entered in the prescribed manner, identifying him.
According to Decree of the Government of the Russian Federation No. 828 of 07/08/1997, every person, if he is a citizen of the Russian Federation and lives on the territory of Russia, is required to have an identity document, and also a child over 14 years of age must receive his own, new passport. The document must include registration of place of residence. There are two registration methods:

  1. permanent (at place of residence);
  2. temporary (at the place of stay).

The first method of registration is recorded directly in the main document of the Russian. That is why you should not worry if your passport is taken away, because... During the registration process, it is confiscated by the Federal Migration Service.

Registration at the place of residence is issued to a citizen who changes his location for a period of more than 90 days. In this case, the main place of registration remains with him, and for temporary registration a certificate is issued, issued by the FMS authorities within 3 days.

Information about the place of residence in the passport is required when providing public services:

  • upon receipt or exchange of the main document;
  • during the execution of any real estate transactions;
  • when registering a marriage at the registry office;
  • when applying for a job;
  • during registration or deregistration at the military registration and enlistment office;
  • when opening an account in any bank;
  • when applying for a loan.

Only with registration a citizen will be able to receive any of the above services.

Residence address

However, such a rule does not mean that a person must be deregistered and receive a new registration stamp every time he leaves home. The current legislation of the Russian Federation allows a citizen to stay in another locality for a period of up to 90 days, during which he does not need to register at a new address. If your stay in a new place is prolonged, in order to avoid conflicts with the law, it makes sense to issue a so-called temporary registration, which is also called registration at the place of stay. It is necessary if the citizen’s permanent registration address and the address of his actual place of residence do not coincide. To obtain it, you also need to contact the territorial office of the Federal Migration Service, providing documents confirming the existence of grounds for obtaining temporary registration, for example, such a basis could be a rental agreement. Thus, if the address of your actual residence differs from the address of permanent registration, you should register at your place of residence. In addition to the absence of difficulties when communicating with inspection authorities, it will provide the opportunity to use the social infrastructure of the locality where you live, for example, to visit a clinic. Theoretically, it is possible to live at a place of temporary residence without any documents: people often do this when they go to work in other regions and maintain a permanent address in their hometown. However, such a situation can create many problems for a person who does not have legal grounds to live in a new place.

What is a residential address, registration address? What is the difference?

  • The registered address is a formal, officially confirmed address. It is indicated in your passport.

    Your residential address is the place where you permanently reside. It is not necessary to indicate it when preparing any documents and in government services, if you are registered - just indicate the registration address.

  • Registration address is the address that is written in your passport. Residence address - your actual place of residence, temporary or permanent. These addresses may or may not match.

    It is still allowed in Russia to be registered (registered) at one address, but actually live in another place. But a bill is being considered that would prohibit housing any person for a period of more than (?) without registration. The fines for violations offered, as always, are not childish.

  • Regarding these concepts, the difference is obvious.

    Your residential address is exactly the address of the place where you live at a certain point in time.

    Registration address is the address where you are registered; this address is stamped in your passport.

    The address of residence and registration may or may not coincide.

  • Let’s say I have a student from another city registered in my apartment - this is his registration address, and he lives with a girl in a rented apartment - this is the address of his place of residence. The military registration and enlistment office calls him on my home phone.
  • Registration address is the registration address. That is, the address that is indicated in your passport.

    And the residential address is the actual residential address, that is, the address of the place where you live.

    For example, a person may be registered in one apartment, but buy another apartment and live in it, but do not change his registration to a new place.

  • In every passport of a citizen of the Russian Federation there is a page entitled PLACE OF RESIDENCE, this page must be stamped with the region, the local police department and in giant letters REGISTERED and then the address - this is the registration of the place of residence.

    if you live at a different address - with relatives, friends or in a rented apartment - then this is your actual residential address. Moreover, these can be not only different houses and streets of the same city, but also different cities, if you have not registered temporarily (temporary registration).

  • The registration address is the address that is on the second page of the passport, there is still a stamp there. That is, in popular terms, this is registration.

    Residence address is the place where a person lives, despite what is indicated in the passport.

  • The registration address and the address of your actual residence can be either the same place/house/address, or they can be in completely different places.

    The registration address is the address where you were originally registered (this is the same address that is written in your passport).

    Residence address is the place, the address where you currently live (this address can be a permanent residence address or a temporary place of residence). After you move to live in another house, at a different address, then this place will become your residential address. In this case, the registration address does not undergo any changes.

  • The residential address and registration address may be the same, or they may be different. What is the difference? The difference is that a person may have a registration mark in his passport, but his residential address is completely different. That is, he lives in one place, but is registered in another.
  • The registration address is the address that is indicated in your document, in fact, you must live there, since you are registered there, that is, you are listed there

    and the residential address is the actual address where you are currently staying.

    All documents are sent to the registration address, since you can live anywhere.

  • Your residential address is the reality in which you live. The registration address is a fact noted in your passport, but nothing more.

Important nuances regarding the registration address at the place of residence, which must be taken into account when receiving a stamp in the passport, where it should be.

It would seem that the concept of address of permanent registration at the place of residence is a simple concept, but it raises many questions. What is it, how does it differ from the residential address. Why is the treasured address stamp so important?

Is a document valid without a stamp in the Russian Federation?

A passport that does not contain registration is considered valid. Legally, all civil rights and freedoms remain assigned to a person even in the absence of a registration mark in the main document. But in practice , a person who has a passport without registration will be limited in the provision of certain social benefits :

  • registration of a policy for free medical care;
  • receiving SNILS;
  • receiving benefits and subsidies;
  • enrollment of a child in a childcare center or school.

A citizen may have a passport without registration if he left one place of residence, but did not have time to register for another.

Important! A citizen who does not have a registration record in his passport beyond the established period is subject to penalties. For residents of Moscow and St. Petersburg, the fine is according to

Code of Administrative Offenses Article 19.15.1

from 3 to 5 thousand rubles, for other Russians - from 2 to 3 thousand rubles.

Fines for violations

By law, the place of permanent registration must correspond to the place of residence, otherwise citizens are required to notify the official services about this. If this is not done, then the person may be charged with administrative sanctions, the application of which involves the imposition of a fine in the amount of 2 to 3 thousand rubles (from 5 to 7 thousand rubles for cities of federal significance) for accommodation without registration. Administrative sanctions also await the landlord who allows persons to live without registration.

How long does it take to complete and for how long is it taken away?

How many days it takes to register depends on the method and place of application . You can send an application:

  • Through the Gosuluga website. After receiving the application, employees must set a date and time for admission to the FMS within 3 days. The registration of registration itself takes place on the day of application.

  • By Russian Post. An application sent by mail must be notarized, which is an additional cost. Registration is carried out by the Federal Migration Service within 3 days from the date of receipt of the application.

  • Personal visit. When visiting the Federal Migration Service, registration is carried out within three days in accordance with Order No. 984 of the Ministry of Internal Affairs of the Russian Federation dated December 31, 2017. When contacting the MFC, this period increases almost 2 times and is 8 days.

Confiscation of a passport for registration of a new place of residence is a legal procedure . Instead, the citizen is given a receipt indicating the full name and period of seizure.

If more complex situations arise, when the period for consideration of the case for a new registration is more than 10 days, the state body of the Federal Migration Service issues a temporary identity card, into which a photograph is pasted and basic information is indicated. The validity period of such a certificate is limited to a month.
