  • An explanatory certificate indicating information about the contractor, details of permitting documentation, information about the owners of adjacent land plots, a brief description of the work.
  • Terms of reference for carrying out the procedure for setting out boundaries.
  • A duplicate of the identity card of the executor-surveyor or a certificate of a legal entity.
  • Photocopies of title documentation.
  • Materials of geodetic field surveys.
  • List of possible prohibitions regarding the operation of the allotment.
  • A technical plan of the boundaries of the site, formed on the basis of topographic photography, indicating characteristic points, external limits, linear distances, data on the owners of adjacent plots and the owner of the object.
  • Power of attorney, if a representative of the interested party participates in the procedure.
  • The act of transferring and accepting land surveying signs for storage to the owner of the land.

When receiving documents based on the results of setting out boundaries, you should ensure that the engineer submits all the certificates listed in this list. The documents must bear the signature of the performer and his seal.

Who can do it and is it possible to do it yourself?

Only a cadastral engineer has the right to carry out this type of work.

But it’s one thing to have the right, another thing to be able to physically do it. Before Federal Law 221 came into force, when cadastral engineers appeared, geodetic organizations were engaged in removing boundaries. In particular, land surveying engineers. Many of them have now become cadastral engineers. In fact, this work is purely geodetic in nature and can be done by any surveyor with the appropriate equipment. But from a legal point of view, this is the “fiefdom” of the cadastral engineer. If a surveyor does this work improperly, it will be difficult to achieve legal consequences for him, because officially he cannot draw boundaries.

The question also often arises: is it possible to independently check the boundaries of your site and correctly install boundary signs? In principle, it is possible, because in the same cadastral extract in section B5 or an extract from the Unified State Register of Real Estate in section 3.1 you can find the dimensions of the plot. Having a tape measure of at least 20 m in length and some knowledge of geometry, you can mark out an area even of irregular shape (if you can stretch the tape measure). That is, transfer the configuration of the site to the terrain.

But there are two main problems that the average land owner cannot cope with without special equipment. The first is if the border of the site has a complex geometric shape. In this case, tape measure will no longer help. And the second, most important, is that it is impossible to determine the location of a site if there is no fence, building or group of pegs on the ground that correspond to the cadastre and you can clearly identify them. It is not possible to check the compliance of these boundary markers with the cadastral data yourself - after all, someone installed these objects, and it is unknown how correctly they are located on the ground. If there is something to “catch on to” and you are sure of their correctness, then you can try. But in this case, if you make a mistake and, for example, install a permanent fence in the wrong place, you will only have yourself to blame.

In what cases is it necessary to remove boundaries?

The main condition for carrying out this procedure is that the boundaries of the land plot must be registered in the cadastral register, that is, land surveying has been carried out in relation to it. Determining the boundaries of a site on the ground is important, and sometimes necessary, in the following cases:

  • if there are no contours or fences by which the location of the site can be determined. For example, it happens that newly formed land plots in an “open field” are sold. Usually they are marked with boundary signs by the sellers themselves. But sometimes they are destroyed for various reasons - and their location can be restored by moving the boundaries to the area;
  • if there is a suspicion that the border (fence) with neighboring areas is installed incorrectly for some reason. Often neighbors try to do a “dirty thing” and put a fence on someone else’s territory. In doing so, they are usually guided by their own conjectures and tape measurements of boundaries. Only a specialist can help establish the truth in a dispute with each other;
  • When purchasing a plot, it is advisable to resort to this procedure in order to be sure that you are buying exactly the plot with the agreed area and boundaries. Otherwise, you may not get a new plot, but lawsuits from your neighbors. A forensic land management examination most likely cannot be avoided. And this is a different order of prices.
  • When selling a plot, it would also be useful to make sure that the cadastral boundaries of the land plot correspond to the actual ones. The act of removal with the binding of boundary points (more about it below) will convince the buyer of the reliability of your offer.

In controversial cases, it is desirable for all interested parties to be present so that questions of interest can be answered in real time.

Filing a claim to restore the boundaries of the land plot

If the boundaries of adjacent plots overlap each other or if a cadastral error occurs, registration work will be suspended until the circumstances are clarified. Depending on the extent of violations found, registration may be suspended, with the right to file a lawsuit.

The same applies to disputes with neighbors. For example, the buyer purchased a plot without land surveying, the boundaries of the land plot were established according to the words of the seller. Statement of claim

The claim is filed in the name of the magistrate, indicating the parties to the dispute. In the main part you should indicate:

  1. Circumstances under which ownership of the land plot arose.
  2. Its cadastral characteristics, location.
  3. The circumstances under which the dispute arose. Evidence of the legality of the claim, an indication of the violation of the rights of the plaintiff by the defendant.
  4. Measures taken by the plaintiff to resolve the dispute by agreement of the parties (pre-trial procedure).
  5. The defendant's response to an attempt to resolve the dispute.
  6. Appeal to the court for recognition of the claim.

The following documents are attached to the application:

  • on the conduct of pre-trial procedures;
  • on the rights of ownership of land plots;
  • evidence of violation of the plaintiff’s rights;
  • the act of drawing boundaries into reality;
  • for representatives – a notarized power of attorney.

State duty

The state fee is paid in the amount of 300 rubles and is attached to the documentation package.

After consideration of the issue in court, the disputing parties will be issued an extract on the decision made. It is prepared within 3 days and comes into force 10 days from the date of issue.

How are boundary marks fixed?


Basically, the delineation of the boundaries of a land plot is required due to the loss of the signs that marked these boundaries.
