Homeowners who owned property before 1998 will face a serious audit - what to prepare for

Obtaining information about a citizen’s real estate in any region of the country is possible only from the national cadastre.
The regional BTI provides information only for its region. Information: the document is handed over to the applicant even in cases where he does not own the property. The certificate is a document of a single sample about the presence or absence of real estate by the owner legally. The BTI certificate refers to strict reporting documents and is issued on standard forms. Who is eligible to receive? According to the law, the document can be issued to the following categories of applicants:

  • individuals (by proxy to their representatives);
  • individual entrepreneurs and legal entities;
  • government agencies (courts, law enforcement, etc.)

Registration of property rights in the BTI before 1998 law

According to Art. 223 of the Civil Code of the Russian Federation (as amended in November 1997) it was established that when the alienation of property is subject to state registration, the acquirer’s ownership rights arise from the moment of such registration. In Art. 131 of the Civil Code of the Russian Federation (as amended in November 1997) it was established that the right of ownership and other real rights to immovable things, restrictions on these rights, their occurrence, transfer and termination are subject to state registration in the unified state register by justice institutions.

A reasonable question arises: should people whose rights to real estate were registered before 1998, when this procedure was adopted, be concerned and do something? Can rights to real estate that arose before the entry into force of the law on real estate registration become obsolete? Are the old documents valid or do they need to be replaced with new ones? We'll talk about this today. How it was, how it became Before the adoption of the law on state registration, rights to real estate were registered by various bodies.

Purpose of receipt

A certificate from the BTI is required when making a purchase or sale transaction of any building, structure or apartment.

In addition, when carrying out redevelopment or transferring residential premises to non-residential premises, it is also necessary to obtain this document.

It should be taken into account that there may be more than one certificate, it all depends on the situation. Most often it is needed:

  • to conduct a purchase and sale transaction;
  • if the apartment was not privatized and it was decided to transfer it into ownership (private houses and other objects);
  • for mortgage lending.

Also, a certificate from the BTI is required when placing on a waiting list for various government programs, for example “Young Family”, the purpose of which is to receive subsidized funds for the purchase of housing.

Forms

It should be noted that certificates from the BTI are provided in several forms and they have a certain validity period.

The most common request is to obtain an explanation. This document is a display of the building plan by floor and its characteristics.

You need to understand that each of the documents is very important for carrying out legal transactions with real estate, as well as for redevelopment.

Quite often a request is made to provide a certificate of appraised value. Such a document is especially needed when selling or buying an apartment or other real estate, making a gift, or entering into an inheritance.

This certificate does not indicate the real value of the object. Appraisals are based on square footage only and do not take into account location, repairs, condition or other factors.

The main forms of certificates are as follows:

  • technical passports of objects;
  • explication in various forms 22 and 25;
  • registration certificate;
  • cost document;
  • land plan;
  • certificate on form 3;
  • documents on the condition of the real estate;
  • extract from the BTI;
  • extract from the technical passport.

Procedure for obtaining a certificate

The question of where to get a certificate of absence of real estate is asked by everyone who is faced with the need to carry out legally significant actions with real estate or the need to receive subsidies.

The registration of information about real estate is carried out by Rosreestr and the Bureau of Technical Inventory, so you should contact the territorial divisions of these government agencies to obtain such a certificate. Moreover, Rosreestr provides information about real estate objects registered after 1998. To issue a certificate of real estate registered before 1998, you should contact the BTI. Information on real estate objects registered throughout Russia is contained in the Unified State Register of Rights to Real Estate and is provided to the applicant when applying to the Federal Service for State Registration, Cadastre and Cartography (Rosreestr). You can also apply for such a document to the MFC or to the Internet portals of State Services and Rosreestr.

A certificate from the BTI about the absence or presence of property can be provided to both individuals and legal entities, as well as individual entrepreneurs and employees of courts, law enforcement and other government agencies. At the same time, such information can be provided to government employees upon official request.

Deadlines

The document will be ready 7 or 14 days after submitting the application.

You can receive it within a few days (3 – 5), but you will have to pay for the rush of production. Most often, in this case, a double tariff is paid.

The validity period of the passport itself is not limited in time. That is, it is indefinite.

There is a legal requirement to conduct an inventory of registered buildings, structures, and structures. It must be carried out every five years.

Therefore, once every five years, it is advisable to conduct an audit of your own real estate by calling BTI specialists, i.e., update the registration certificate. But this requirement is not mandatory.

How to add an apartment to the register purchased before 1998

Thus, the future buyer (donor, pledgee), in order to be sure that the transaction and transfer of rights will be registered for him, can demand from the other party to the agreement (seller, donor, pledgor) a certificate that confirms the registration of the previously arisen right. This provides additional guarantees that you will not be sued for repossession of real estate in the future.

That is, if during the re-registration process it suddenly turns out that the seller (mortgagor, donor, etc.) acquired the property illegally, then registration will not be carried out. But if a lot of time has passed since the certificate was issued, then the information contained in it could become outdated.

Obtaining a certificate from the BTI about the availability of property

When concluding real estate transactions, you cannot do without such a document as a certificate from the BTI on the availability of property. The technical inventory bureau, which is located at the place of residence, is responsible for issuing this document. Just keep in mind that a local authority can provide information only within its department.

About the organization

BTI is a government agency that carries out technical accounting of real estate. Now there are 83 branches, over 1000 branches throughout the country. Accounting is carried out automatically, resulting in a rapid exchange of information between institutions that maintain cadastral records and technical inventories.

The BTI has information about:

  • houses;
  • apartments;
  • land plots.

The organization ensures the uninterrupted operation of the state registration system and the collection of information about objects. It contains information about residential and residential premises. The search for information also takes place in the BTI archives.

Why is paper needed?

BTI is considered a representative office of Rosreestr. The issued papers confirm the presence or absence of real estate in a particular person. Moreover, the property must be registered in ownership. Information about an object can be obtained in any region of the country from the national cadastre. The regional authority provides information only for its region.

The document is provided to the applicant even if there is no property. BTI certificate is a single type of paper indicating the legal ownership of property. The document provides strict reporting, so it is drawn up for legal transactions.

A proof of housing availability is needed for:

  • registration of privatization;
  • purchasing a mortgage;
  • receiving a subsidy;
  • making other transactions.

A real estate document may have a different validity period, it all depends on the purpose. This period ranges from 1 year to 5 years. The technical passport has no restrictions on its validity period.

Who can get it?

According to the law, a certificate from the BTI on the availability of real estate is provided to the following applicants:

  • individuals;
  • entrepreneurs and legal entities;
  • government agencies.

In the latter case, provision of paper is possible only under legislative authority.

A document with the BTI on the availability of property is drawn up on a special form. Then the registrar signs it and stamps it. The form contains important information:

Certificate forms

BTI is engaged in recording and processing information on real estate on the entrusted site. Specialists are required to issue various certificates and documents to citizens upon request. The most popular documents include a technical passport and an explication.

The technical passport includes the characteristics of the property. Without this paper it is impossible to carry out transactions with property. The explication is a floor plan of the building, which contains the characteristics of the object. In addition to this documentation, BTI provides other certificates:

  • about inventory value;
  • about registration;
  • land plan;
  • extracts from the technical passport.

Before making a transaction regarding the alienation of property rights, you must contact the BTI, making sure that the property is “clean”. The technical passport contains information about the area and number of rooms. It may also contain additional information:

  • about BTI, date of provision of information;
  • number, information about shares;
  • detailed description;
  • list of attached documents.

If the owner has a technical passport, this confirms that the object complies with the law. It turns out that he has no encumbrance, but if the redevelopment is done, it is agreed upon by law.

To obtain a certificate, you must contact the following organizations:

  • BTI, if the property was registered before 1998;
  • Rosreestr, when the object has been registered since 1998.

A certificate of absence of property may be required for the privatization of real estate that was listed under a social tenancy agreement. Paper is also necessary when determining the child’s place of residence if his parents are divorced. The certificate allows the family to be registered for improvement of living conditions. It is ordered to receive subsidies from the state and for other purposes.

A certificate of availability of property is presented to the court when spouses divorce, as well as to banks to confirm that the client can provide collateral. The paper is issued at the request of a social service worker to confirm the need to improve living conditions.

To make a purchase or sale, you need a registration certificate. The paper serves as confirmation that the object is legally “clean”. It contains the characteristics of the property, as well as information about the encumbrance. The new registration certificate will serve as confirmation that the apartment is registered legally.

Although a registration certificate is not mandatory when selling an apartment, the buyer can still inquire about its condition. Therefore, it is advisable for the seller to pre-order the paper so as not to slow down the deal.

Receipt procedure

To obtain a certificate from the BTI about the availability of property, you need to prepare a list of documents:

  • passport;
  • power of attorney, if the procedure will be executed by an authorized person;
  • Marriage certificate;
  • children's birth certificate;
  • right of inheritance;
  • receipt for payment for bureau services.

This list of documents is provided in originals with copies. You can receive the paper by mail. Only in this case you need to write a written request with copies attached. The applicant or his representative can obtain a document confirming the availability of real estate. By law it is prohibited to provide information to other citizens and legal entities. The applicant is given information only about his object.

The paper production time varies depending on the type of document. This may take 5 days or a month. If the property is large in area, then registration will take a lot of time. With rapid production, the price of paper increases.

Contacting the MFC

A document confirming the availability of a house or apartment can be obtained from the MFC. Such organizations have not been operating in Russia for very long, but have already become in demand. Citizens have the opportunity to use different document processing services in one building.

The advantages of the MFC include fast service and time savings, which is why people turn to the institution on various issues. But there are no such organizations in many remote areas, so people need to contact the BTI or the post office.

Order through State Services

Using the State Services website, it is possible to order certificates. There you can leave a request for a technical passport, floor plan, document about the address of the property and a certificate of inventory. The disadvantage of applying online is that the processing of the application begins after payment of the fee.

First you need to register on the site if you don’t already have a personal account. Then find your city. If it is not on the list, it means that such a service is not available in your city.

You will have to contact the institution itself. If such a service is available, then the application must indicate personal data and contact information. After this, you need to pay the state fee.

Receiving paper via the Internet greatly simplifies the entire procedure.

Expenses

Paper provision services are not free. The cost of the certificate may vary depending on the location. The exact price can be announced in the institution itself. How much does a certificate cost approximately? The average price is 1000 rubles. Additional certificates for each applicant will cost an additional 200 rubles.

Each organization sets price lists based on local conditions. Some certificates are issued free of charge. Payment is made through the cash register, in banks, terminals and at the post office.

Nuances of receiving

If the document is needed by the heir, then to receive it, you must provide a certificate of this right, issued by a notary. The certificate records all property and is not divided into several papers. It indicates the address of the property, the method of obtaining it, the number and date of the contract.

When sending an application by mail, it must be certified by a notary. Only then will it have legal force. After reviewing the application, a response will be sent to the specified address.

What types of BTI certificates are there?

A complete list of certificates issued by BTI authorities can be found by personally contacting the specified institution, or on their official websites. Let us highlight the most common types of certificates that are of practical importance for citizens and legal entities:

  • an extract from the register book on the ownership of the property as of 01/01/2000;
  • a certificate of the inventory value of a building, structure, premises or other object;
  • a certificate of the characteristics of the object according to state technical records;
  • extracts from the technical passport of the BTI in form 1b;
  • issuance of their technical passport for the building (structure) in form 1a;
  • copies of the archival inventory file for the facility;
  • certificate of the condition of the building according to form No. 5;
  • floor plan of the building and its explanation
  • certificate of condition of a residential or non-residential property;
  • address identification certificate;
  • other types of forms and forms.

Let's consider the content and practical significance of some types of BTI certificates.

Certificate from the BTI for registration of real estate: how to get it, how much it costs
When registering an inheritance, it is necessary to determine the value of property assets, including real estate. For the purposes of inheritance, the legislator allows citizens to determine by what cost indicators the state duty will be calculated. It is allowed to use the indicator of the inventory value of the property; this information can be obtained upon request from the BTI.

The inventory value may differ significantly from the cadastral value, therefore, to reduce the amount of the state duty, it is necessary to compare these two indicators (you can find out about the current cadastral value of an object upon request to Rosreestr). A certificate of inventory value of an object indicates its price taking into account standard wear and tear and the residual value.

Certificate from the BTI for registration of real estate: how to get it, how much it costs

The floor plan contains a drawing of the premises, and the explanation to it defines information about the parameters of the property (including the size of the total and living area). Obtaining a floor plan with an explanation may be required to draw up a redevelopment project and have it approved by the authorized bodies. Please note that changes after redevelopment work can only be recorded by drawing up a technical plan and submitting it to Rosreestr for cadastral registration. BTI bodies do not have the authority to prepare technical plans; these functions are performed by a cadastral engineer (the BTI staff may also include cadastral engineers, in which case they can draw up a technical plan).

To prepare project documentation, you may also need a copy of the technical passport of the premises. In this case, the document will contain a floor plan with an explanation, as well as an address plan. An extract from the technical passport in form 1a includes information about the area, number of storeys, date of construction of the building, materials of walls and ceilings. The certificate in form No. 5 indicates data on the depreciation of the object (building, residential or non-residential premises), information on engineering communications or their absence, the date of commissioning of the object, etc.

Certificate in form No. 11 contains information about private households. Its receipt may be associated with the need for major home repairs, redevelopment or reconstruction, expansion of living space, etc. Certificates of address identifiers contain data on the assignment of a postal address to an object, renaming of streets in populated areas, etc.

  • registration of privatization;
  • purchasing a mortgage;
  • receiving a subsidy;
  • making other transactions.

A real estate document may have a different validity period, it all depends on the purpose. This period ranges from 1 year to 5 years. The technical passport has no restrictions on its validity period.

What you need to prepare for

The Federal Tax Service is going to conduct a large-scale audit in order to establish the exact data of the property, the owner and more accurately calculate the tax. If no tax was previously assessed, the tax authorities may assess additional tax for the last three years. Additionally, the Federal Tax Service may fine the owner for failing to notify the tax authorities of his real estate ownership.

In each municipal district, local authorities will begin to collect and analyze data on all real estate properties registered before 1998. Information will be collected using various requests (including to the police, housing and communal services, notaries, civil registry office, Pension Fund of the Russian Federation, Rosreestr, etc.). After receiving the data, information about the object will be published on the official website of the administration.

All owners of such objects must monitor the site and see if their object is missing and, if so, carefully check the information. If the information is not correct, you should contact the administration yourself and clarify the data. After this, the administration prepares a draft decision and publishes it on the official website and additionally sends it to the owner’s email. U

the owner has 30 days to submit his objections if the decision contains inaccurate information about the owner or characteristics of the property. If no objection is received, the decision will be approved and the information will be transferred to Rosreestr, where corrections will be made. After which, the Federal Tax Service will carry out an inspection based on new data.

“The floor plan” is ordered, in particular, for the design of Opens in a new tab.”>redevelopment of the apartment. Red lines on the floor plan indicate unregistered changes to the apartment plan.

The floor plan of the apartment is a graphic application of both the Cadastral passport of the apartment and the Technical passport of the apartment. You can see what the floor plan of the apartment looks like as part of the cadastral and technical passports of the apartment - in the section Opens in a new tab.">"Samples of documents."

Based on the “floor plan”, an explication of the apartment is drawn up.

The cadastral passport of an apartment is an extract from the State Real Estate Cadastre (GKN), containing information necessary for all types of registration actions with the apartment.

From 01/01/2013 Cadastral passports for registration purposes are issued ONLY by the Cadastral Chamber of Rosreestr (FGBU FKP ROSRESTRA for Moscow).

At the same time, local BTI can also issue Cadastral passports, but for other purposes, for example, to obtain various permits and approvals NOT related to registration actions.

For more information about it, and whether it is needed to sell an apartment, see the Glossary section. Opens in a new tab.">"Cadastral passport of the apartment."
