Accounting for apartments, residential buildings, and non-residential premises was previously carried out by technical inventory authorities. But Federal Law No. 221-FZ of July 24, 2007 introduced a new procedure for recording real estate objects - information about them must be contained in the State Property Committee (from 2021 - in the Unified State Register of Real Estate). The technical passport for an apartment is currently not a significant document, but nevertheless, situations arise when it is exactly what is needed. In this article, we will consider in what cases you should order a registration certificate, and whether it is possible to do without it completely.
The main misconception about the technical passport
The most common myth about a technical passport, which can most often be found on the Internet, is that this document is required for every purchase and sale transaction.
A technical passport is not needed to register the transfer of rights to an apartment in Rosreestr.
Since since 2013, information about real estate objects has been entered into the Unified State Register of Real Estate on the basis of a technical plan, technical passports have lost their former relevance. Registration of an apartment, making changes to the area (redevelopment) - these actions are registered according to the technical plan.
Currently, apartment owners are not required to have a registration certificate, much less renew it every five years.
Documents for obtaining a BTI cadastral passport
To receive a cadastral passport, you need to present a technical passport for the object. If you do not have a technical passport, then in order to produce a cadastral passport for registering real estate rights, you need to present the following documents:

When is a registration certificate needed?
We list all the circumstances when you may need a technical passport:
- When registering a deposit for an apartment.
If the purchase of an apartment involves borrowed funds, a registration certificate will be required to obtain a loan agreement. And the agreement, in turn, is for registering the transaction.
- When remodeling an apartment.
To obtain permission, a technical passport and a redevelopment project are submitted to the local government authority. The technical passport indicates the current state of the apartment, the project indicates the planned changes.
- In case of legalization of redevelopment through the court.
A registration certificate is necessary to understand what the apartment was like before its illegal redevelopment.
- Using a technical passport prepared before 2013, you can enter information about the apartment as previously registered. This is necessary if the Unified State Register does not have information about your apartment.
In this case, you can save on the production of a technical plan. Let's assume you have a registration certificate for an apartment from 2004. It is necessary to submit an application to Rosreestr through the MFC to register the apartment as previously registered. The registration authority itself will request information from the BTI in the order of information interaction. When the BTI confirms to Rosreestr that this apartment has undergone inventory, it will be assigned a cadastral number and the status “previously registered.”
Using a registration certificate issued later than 2013, you cannot register an apartment.

In most of these cases, if you have never had a registration certificate, you do not need to order one. Offer instead a technical plan or an extract from the Unified State Register of Real Estate.
As for the preliminary inspection of the apartment for the presence of illegal redevelopment, you need to be guided not by the technical passport data, but by the information from the Unified State Register of Real Estate. According to the law, all types of certificates requested from the BTI are issued within 30 days from the date of application; in practice, a document ordered through the MFC will be ready in two to three weeks.
The validity period of each individual certificate, document or extract differs, and can last from several days to a year; the new technical passport is valid indefinitely.
