How to determine a kindergarten by place of residence

Do I need registration when lining up for kindergarten?

one is 2 months old, the other is 2 years old. Of course, I wanted to take my eldest to the garden in the fall. Did you want to take her to the garden without getting in line until now? Didn't you know about electronic registration and the queue? In fact, workarounds are the same as they were before, as they are now. Whether it’s for money or not, I don’t know, I know that there are two well-working methods: 1) write letters of complaint to Putin or Medvedev on a blog - “you have to go to work, there’s not enough money, there’s nothing to live on, and they don’t give you a place in the garden.”

The procedure for providing space in a garden in Russia is determined by several federal and regional laws. One of the main conditions for enrolling a child in kindergarten is registration in the municipality in which the preschool institution is located. However, situations where the parents of a family live in one locality and are registered in another are not so rare.

Options for getting a place in kindergarten without permanent registration

Problems with admission to a preschool educational institution may arise if:

  • there is no permanent registration;
  • the actual place of residence does not coincide with what is indicated in the passport;
  • the selected institution is located in another district or city.

Below are described the ways in which it is possible to take your child to the preschool institution that you have chosen without having a permanent residence permit.

Entering kindergarten without registration

Temporary registration

Registration at the place of residence in the area where the garden is located is the best option. It is enough for one of the parents to register so that the minor has the opportunity to register at the same address.

You cannot register one child. According to the law (Civil Code of the Russian Federation, Article 20, paragraph 2), a child under 14 years of age must live with one of the parents. The owner of the property cannot object to registering the child at the place of registration of his parent.

Therefore, if the parent himself does not have a residence permit in the place of his actual residence, then he must first obtain one. In this case, when applying for temporary registration, the presence of the owner of the living space is mandatory. When the parent is registered, the child is registered without the consent of the owner of the property.

What is your registration?

Registration at the place of residenceRegistration at the place of stay

If you have a notarized lease agreement, then you can obtain temporary registration without the consent of the owner of the premises.

If you have temporary registration, you can submit documents to enroll your child in kindergarten. This does not mean that the baby will be able to go to kindergarten right away. He will be put on a waiting list. When a free place becomes available, parents will be notified.

The list of benefits in each city may differ, as they are determined by the city administration based on currently existing federal laws.

Getting a sponsorship spot

When enrolling in a preschool educational institution, it is possible to pay for a place, called “Sponsorship”. The manager gives a list of what is needed for the institution. You provide the kindergarten with what it needs and in return your child is given a place.

From the experience of modern mothers, we can say that voluntary sponsorship of 10 thousand rubles and more is widespread everywhere. Therefore, in order to count on a place in kindergarten, the amount of the contribution must be significant. Is this considered a bribe and something illegal? Rather yes than no.

Private institution

If there are no places in a budgetary public garden, you can find a way out by paying for a private organization. There are a lot of such gardens at the moment. Prices vary. When enrolling, no one will ask for registration and you will not need to wait for a place to become available.

Is it possible to place a child in kindergarten without registration?

Since 2012, an electronic queue has been maintained for admission to kindergartens in Russia. It is expected to go through the registration procedure with writing an application in the established form and attaching documentation for enrollment in an extraordinary or preferential format, if such a possibility exists. However, the queue number will increase if preferential citizens subsequently submit documents.

In the kindergarten, experienced specialists with pedagogical education work with children. Home education may not always have such a beneficial effect on the psychological development of the child. In a children's institution, educators and psychologists will take an individual approach and allow the child to take advantage of the best opportunities for development.

  • When submitting documents to such institutions, physical and psychological characteristics are taken into account; the solvency of the parents is also important.
  • But it is still worth checking with the administration when submitting documents whether the child’s registration is required for admission.
  • A situation is possible when a child is admitted to kindergarten without registration.

The operating hours of most gardens coincide with the working hours of many organizations (from 7 am to 7 pm on weekdays). Based on the law of the Russian Federation, absolutely every citizen of a given country who arrives and lives outside their place of residence for more than three months must register at their place of residence. This obligation applies to all people, regardless of their age.

Is registration required for a kindergarten by law?

Kindergarten (abbreviated as preschool educational institution) is an educational institution. Let's look at two main documents that will help answer the question: “Do you need registration?”

Law of the Russian Federation No. 5242-1 (Article 3) states that lack of registration cannot be a reason for restricting human rights and freedoms, and the Constitution of the Russian Federation (Article 43) establishes that everyone has the right to receive education. Therefore, according to the law, lack of registration does not cancel the child’s right to enter kindergarten.

Everything that concerns the admission of preschool educational institutions is also spelled out in the legislation - Federal Law No. 273 “On Education in the Russian Federation”. The articles governing this provision are provided in the table below:

NameDescription
Art. 5, paragraph 1 and 2 Every person has the right to education, regardless of place of residence.
Art. 67, paragraph 2-4 A certain children's institution is assigned its own territory and, first of all, children living there are accepted.
Refusal of admission can only be due to lack of places.

They may refuse if:

  • no places;
  • the child did not pass the competitive selection;
  • kindergarten for children of employees of the Ministry of Foreign Affairs.

For illegal refusal, the responsible persons are punished with fines from 30 to 50 thousand rubles (Administrative Code of the Russian Federation, Art. 5.57).

It turns out that the child has the right to receive an education, and the lack of registration cannot cause a violation of this right. At the same time, the same Article 3 of the Law of the Russian Federation No. 5242-1 states that citizens are required to have a residence permit (permanent or temporary).

Violators of the law face a fine of 2 to 3 thousand rubles (Administrative Code of the Russian Federation, Art. 19.15.2). The fine for the child is paid by his parents, since he has not reached the age of 16 to bear administrative responsibility for himself. Therefore, if a parent and child do not have any registration, then this is a double fine for breaking the law.

What documents must be submitted to the kindergarten to be placed on the waiting list?

Upon admission, additional documents may also be requested. You may need a certificate for the pool (Form 1) which confirms that the child is healthy and has no infectious or skin diseases, in addition, a doctor’s recommendation for attending health classes in the pool. This certificate is issued for a period of six months. Then it will need to be replaced with a new one.

What documents do parents need to collect in order to get into kindergarten? This question worries all mothers and fathers whose babies are growing up. It should be immediately noted that the documents for kindergarten differ. The first ones are submitted to place the child on the waiting list for kindergarten. The second is directly upon admission of the baby to kindergarten.

To kindergarten - at your place of residence

The following message recently appeared on the official website of the regional prosecutor's office: “...at the request of the prosecutor of the city of Kemerovo, the court ordered the administration of the city of Kemerovo to fulfill the requirements of the law and adopt a regulatory legal act on assigning preschool educational organizations to specific territories of the city district. Now it is clearly defined which kindergarten a child can be enrolled in depending on their place of residence.”

Does this mean that children now need to be sent to kindergartens only at their place of residence, like to schools? What law says this? We addressed these questions to the Department of Education and Science of the Kemerovo Region.

Enrolling a child in kindergarten: recommendations for those who do not have registration

If you live in a rented apartment, talk to the owners. Many go to the extent of providing tenants with temporary registration without the right to housing. This is especially true for those who come to a big city from the region. Make sure to make photocopies of all documents in advance.

It is possible that the owner of the rented apartment will refuse you. Don't worry, your child still has a chance to get into kindergarten. If you rent an apartment through an agency and you have a supporting document (for example, a rental agreement), you can safely enroll your child in kindergarten at your place of residence. Again, you need to contact your local education department. In this case, a copy of the apartment rental agreement is added to the mandatory set of documents. In this case, the specialist has the right to put on the queue without registration.

The fact is that state funding of educational institutions is carried out according to the principle: as many heads - so much money. That is, for each additional child, the kindergarten receives additional funding and not only state money, but also “parental money”. Therefore, if the group is understaffed, the child will be accepted without registration.

It is the latter who clearly prescribes not only the admission rules, but also the list of necessary documentation. So, in addition to such data as name, date and place of birth, in the application for admission of a child to a municipal preschool institution, it is required to indicate the child’s place of residence.
