What is a 2021 survey report?
The legal definition of the inspection act is contained in Art. 23 of Law No. 218-FZ “On State Registration of Real Estate” (). The survey report is a document in which the cadastral engineer, as a result of inspecting the location of the real estate property, confirms the cessation of existence:
- buildings, structures, houses or unfinished construction due to loss or destruction;
- premises, parking spaces in connection with the death or destruction of a building, house or structure, or their parts in which they were located, the death or destruction of a part of a building or structure.
In simple words, by drawing up survey reports, it is confirmed that the real estate property no longer exists in kind. Therefore, the acts are the basis for conducting cadastral registration in Rosreestr and excluding information about the object from the Unified State Register of Real Estate. - type of inspection performed,

Members of the commission are listed below in order, indicating their position. The following is a table containing three main columns:
- name of the systems and elements inspected;
- condition assessment;
- decision about the need for repairs.
Data for the first column can be found in Appendix 7 of the Decree of the State Construction Committee of the Russian Federation dated September 27, 2003 N 170.
The second column records the condition of each element of the structure or infrastructure. If an item passes inspection, it is indicated to be in excellent, good or fair condition.
If a particular house does not provide any element from the template list of the document, the column records that it is missing.
When a defect is detected, its nature, possible causes, exact location and approximate amount of work to eliminate the malfunction or damage are briefly described. A mark indicating the unsatisfactory condition of the element is placed.
The last column includes the type of repair required: “routine”, “major” or “not required”. The measure is determined by the commission based on the condition of the element being checked.
After reading the document, all members of the commission who took part in the inspection of the house put their signatures in the appropriate columns.

Building inspection report
Preparation of an inspection report for a real estate property is the first stage of removing the inspected property from the cadastral register in Rosreestr. General requirements for carrying out cadastral work are approved by Law No. 221-FZ (). The procedure for drawing up the document is contained in Order of the Ministry of Economic Development No. 861 (). This regulatory act prescribes that the act is prepared exclusively by a cadastral engineer after inspecting the object and assessing its technical condition. Apart from confirming the fact of loss of physical existence, the act does not carry any other functions.
The basis for preparing an act for a building is only an inspection of the capital construction project. Requirements for the structures of an existing facility are determined by Federal Law No. 384-FZ (). Documents that confirm the destruction of real estate may also be attached to the act. Here is their approximate composition:
- protocols and acts of field (visual) commission inspection;
- decisions of state and municipal bodies;
- commission interdepartmental conclusions;
- owner decisions on dismantling and demolition;
- other documentation.
The act is prepared taking into account the information of the Unified State Register of Real Estate (USRN). If the object was not initially registered in the cadastral register, removal is not carried out.

Inspection of premises, buildings, areas and vehicles
– operational surveillance, which consists of a visual or technical examination of objects in order to detect persons, objects, documents, hiding places, etc., as well as to identify circumstances related to criminal activity.
The event can be held: a)
publicly as part of an official audit by operational staff together with authorized inspectors);
b)
secretly or using measures of secrecy (legendation);
c)
on behalf of an operational officer by a person providing confidential assistance to the authorities;
d)
on behalf of an operational officer, representatives of organizations who, due to their official duties, are granted the right to enter the territory of interest (fire inspection officers, electricians, etc.).
Conducting operational inspections that limit the constitutional rights of a person and a citizen to the inviolability of home, inspection of residential premises is allowed only on the basis of a court decision. In other cases, the examination is carried out on the basis of the relevant resolution approved by the head of the unit.
Thus, in accordance with the Law of the Russian Federation “On the Police”, if there is evidence of a violation of the legislation regulating economic activity, by order of the head of the police department (police agency) or his deputy, police officers are given the right to perform their duties: 1)
carry out, in the presence of at least two witnesses and a representative of a legal entity, an inspection of production, warehouse, trading and other office premises, other places of storage and use of property;
2)
study documents reflecting financial, economic, entrepreneurial and trade activities, demand the provision of duly certified copies of these documents within five days from the date of delivery of the relevant resolution;
3)
seize, with the obligatory drawing up of a protocol, individual samples of raw materials, products and goods necessary for conducting research or examinations, etc.
If original documents are confiscated, copies are made of them, which are certified by the official of the internal affairs body (police agency) conducting the inspection or audit, and handed over to the person from whom the original documents are confiscated. If it is impossible to make copies or transfer them simultaneously with the seizure of the original documents, the official of the internal affairs body (police body) conducting the inspection or audit shall transfer certified copies of the documents to the person from whom the original documents were seized, within five days after the seizure, about which a corresponding entry is made in the seizure protocol.
The results of the examination are reflected in a report or certificate drawn up by the operational officer,
to which (if available) photographs and video recordings, an examination protocol, an inventory of seized items and documents, explanations and statements of persons participating in the event are attached.

Premises inspection report
You can prepare an inspection report for the premises separately from the inspection report for the building (or structure). Because the inspection act is the basis for deregistration of this object, then having drawn up an act for the premises, the cadastral engineer confirms the fact that the building in which this premises is located has ceased to exist.
When deregistering a lost premises, information about the building is also removed from the cadastre due to its destruction (or other reason for its cessation of existence). The same thing happens when the entire building is deregistered, and it contains premises registered in the cadastre - the registration information in relation to them is also canceled.
Expert commentary. It is possible that an inspection report will be drawn up in the event of the loss or destruction of part of the building. In this case, new data will be entered into the Unified State Register for the building, as its parameters will change. The premises located in the destroyed part of the building will completely lose their existence. This fact will be confirmed by an act or deregistration from the cadastral register.

Sample inspection report 2021
The standard form of the inspection report is approved by Order of the Ministry of Economic Development No. 861. This normative act regulates the requirements for the inspection report of any real estate property. The Appendices to Order No. 861 contain a standard sample act, contents and requirements for correctly filling out the document. It is impossible to draw up an act in any form, since otherwise it will not be accepted by Rosreestr.
The survey report confirms that the property has lost its physical existence. After this, the object will be removed from the cadastral register.
Basic rules for drawing up an act
As mentioned above, several people should participate in the inspection of, for example, an apartment if this allows for a reliable assessment of the premises. All data must be recorded in the prepared document.
The legislation does not have strict guidelines for conducting a premises survey.
The number of participants in the commission must be at least 2. Their number will depend on the purpose of drawing up the recording document.
To ensure the objectivity and reliability of what is recorded in the document, members of the commission must be specialists competent in carrying out the procedure, for example, engineers, technicians.
There is no form approved at the state level for the act; therefore, it can be drawn up either by hand or printed on a computer.
The premises inspection report form must contain:
- data about the premises being inspected, for example, a one-room apartment with an area of 55 m2, located at (specify address);
- information about the members of the commission, their positions, full names;
- deficiencies and comments identified during the inspection;
- accurate conclusions of specialists;
- indicate whether damage has been caused to the premises if the inspection is carried out for this purpose;
- if there is any harm caused, indicate the culprit, as well as cause-and-effect relationships.
The document can be drawn up both in descriptive form and in tabular form.

- a document confirming the comprehensive development of the built-up area on which the object to be demolished is located;
- other documents on the basis of which the decision on demolition (dismantling) was made in the event of forced seizure of the object from the owner; decisions to demolish unauthorized buildings;
- a decision to demolish a capital construction project independently made by the owner;
- court decision to demolish the building;
- design documentation in case of demolition or dismantling of a capital construction project, its parts for construction, reconstruction of other objects;
- documents confirming the fact of natural disasters or other emergency situations.
Copies of documents containing USRN information are not included in the act. In the column “Conclusion of the cadastral engineer”, in the form of a coherent text, the conclusion about the termination of the existence of the property is given.
Expert commentary. If the object ceased to exist after August 4, 2018 as a result of its demolition, information about the notification of the local authority about the completion of the demolition is entered in the “List of documents...” column. This requirement was introduced by Order of the Ministry of Economic Development No. 166.

How to deregister a building based on an inspection report
Having received the inspection report, you can contact Rosreestr and remove the object from the cadastral register. To do this, fill out and submit an application directly to Rosreestr, or through the MFC. A typical sample application can be found in the list of useful documents.
The rules for removing an object from cadastral registration are as follows:
- simultaneously with the cancellation of the cadastral number, ownership of the object is terminated (rights to the land plot under the destroyed object are retained);
- the procedure for deregistration does not require payment of state duty;
- the period for reviewing documents and deregistration is 7 days (through Rosreestr) and 9 days (through the MFC);
- after deregistration, the applicant will receive an extract from the Unified State Register.
Composition of the commission
A whole commission is usually involved for a technical inspection of the facility.
The composition of the commission is appointed based on the circumstances under which the control measure is carried out.
If this is the acceptance of a newly built structure, then the commission includes representatives of several organizations that participated in the construction. And if a building is inspected that has long been owned by some organization (for example, after winter and spring flooding), then the commission will consist of employees of the enterprise.
