FORUMHOUSE member Andrey with the nickname GOOSE had a plot of four hundred square meters in the Razliv gardening and a dacha in Sinyavino. And so at the family council it was decided to build a dacha in Razliv. Confident in himself and his abilities, Andrey decided to master the wisdom of construction on his own. A search for information on the Internet led him to FORUMHOUSE, where he stayed, preparing for future construction.

1 weave is equal to 100 square meters. The optimal size of a plot for a private house or a spacious cottage is an area of 10 to 15 acres or 1-1.5 thousand square meters. m. For a dacha or a compact country cottage, it is optimal to choose a plot of 6-7 acres or 600-700 sq. m.

How many acres of land do you need to build a house according to the 2021 law?

However, those who continue to remain silent about the presence of private housing construction on the site should know that obtaining permission from the administration to put it into operation can be considered an impossible action.

  • There should be at least 3 m from the house to the fence.
  • The residential building must be located at a distance of at least 15 m from the forest.
  • Buildings housing livestock and poultry are located at a distance of 4 m from the fence of the site.
  • The street toilet is located at a distance of at least 12 m from the neighbor’s house. From the restroom to the bathhouse, sauna there should be a distance of 8 m or more.
  • Shrubs are located at a distance of at least 1 m from the neighbors' fence. If these are short trees, they are 2 m from the fence, and tall, fruit trees - 4 m.
  • Outbuildings are located at least 4 m from the property line. The roof slope should be directed so that flooding does not occur.
  • The distance from the house to the outdoor shower, toilet, bathhouse is 8 m.
  • The distance from the well (well) to the compost pit (toilet) is at least 8 m.

According to current legislation, there are 2 types of land. Construction is permitted on garden plots. You can live in a house built on such land. Vegetable garden plots do not involve the construction of a residential building. Only commercial buildings can be built here.

Building regulations

If there is a body of water, a ravine, or a cliff approaching the site from some side, you don’t have to install a fence on that side. But for safety reasons, such objects should still be fenced. Digging a ditch to mark boundaries is prohibited.

The main law regulating the development of sites for individual construction is the Land Code. Locally, they are also determined by an additional list of documents. It is worth noting that citizens from preferential categories can receive land plots in a special manner.

How many acres of land can you build a house on according to the 2021 law?

For example, if we look at recent history, then in the seventies our parents were given 4–6 acres for free in gardening partnerships, and they were very happy about it. A little later, in the nineties and early 2000s, the bulk of the plots had an area of 15 acres. And then, the size of the plots began to slowly increase. What's the matter? And why does this happen? The answer lies in the houses and buildings that people began to build on their suburban plots. If in the seventies a country house made of boards or timber 5 by 6 meters at the base was a luxury, and such a house on a plot of 6 acres looked like a giant, then as you understand, today it is possible to build a house 10x15 meters on a plot of 6 acres, but it is completely pointless . Why? Let's take as an example a regular plot of 6 acres. Its sides will be at best 20 by 30 meters. If you put a 10x15 house in the middle of the plot, it will turn out that there will be only 4.5 meters left to the fence with your neighbors, but you also need to make a blind area for the house and this is at least 50 cm on each side. And in this cramped space, even a few trees will seriously interfere with both the passage and the house itself, since the crown of an ordinary apple tree spreads at least 6-8 meters in diameter. And if you want to drive a car onto the site, then on one side there is no free space left even for a lawn with green grass. I looked at an area of regular shape, but there are also curved areas. In this case, you will have to forget about a house with the usual dimensions today. Or, you need to look for a larger area. But if you get into a car and drive around the nearest Moscow region, while looking around and studying the cottage villages of the mid-90s and early 2000s, where large country houses and modern cottage houses already stand, you can easily see the same problem . In most cottage villages, large, modern houses are built, and they are located very close to each other.

Purpose of land plots

But this outcome only applies to cases where the owner does not carry out any work on the land plot for more than 3 years. If the owner has at least started construction (for example, the foundation has been poured), then work can continue for as long as desired.

Construction norms and rules (SNiPs)

The term “individual residential building” means a separate building with no more than three above-ground floors, no more than twenty meters in height, which consists of rooms and auxiliary premises intended to satisfy citizens’ household and other needs related to their residence in such a building , and is not subject to division into independent real estate objects. The concept is enshrined in paragraph 39 of Art. 1 of the Town Planning Code. At the same time, the parameters established for individual housing construction objects are equally applied to residential buildings and individual residential buildings.

Lawmakers separated the concepts of gardening and vegetable gardening and established new rules for land use, as well as construction on summer cottages. For this privilege, the plot must not be larger than 0.5 hectares. Also, the process of growing/processing products should be carried out by family members without the involvement of outside forces.

The construction of an object on a land plot must be carried out in accordance with the town planning plan of the land plot, which indicates the minimum setbacks from the boundaries of the land plot to capital construction objects on the basis of the town planning regulations adopted by the local government body for the territorial zone within which the given land plot is located.

How many acres of land do you need to build a house according to the 2021 law?

The planning and development of urban and rural settlements is regulated by SNiP 2.07.01−89. According to clause 2.12 of SNiP 2.07.01−89, the distances between residential and public, as well as industrial buildings should be taken on the basis of calculations of insolation and illumination in accordance with insolation standards, illumination standards, and also in accordance with fire safety requirements. In areas of estate development, the distance from the windows of residential premises (rooms, kitchens and verandas) to the walls of the house and outbuildings (barn, garage, bathhouse) located on neighboring plots of land, for sanitary and living conditions, should, as a rule, be at least 6 m. Outbuildings should be placed from the boundaries of the site at a distance of at least 1 m. Blocking outbuildings on adjacent plots of land is allowed by mutual agreement of homeowners, taking into account fire safety requirements.

Land legislation in Russia is still in its infancy. Therefore, situations where the actual and legal area of a plot differ in practice occur very often. Especially if the land was allocated a long time ago. Old areas were allocated without land surveying and without establishing precise boundaries. Often the land was expanded at the expense of empty neighboring lands, and sometimes the neighbors moved the boundaries by mutual agreement. And as a result, according to the documents, the area of such a plot is standard 6 acres, but in fact it is more.

How many acres can you legally build a house on in 2021?

If the plot is a country house and small and you want to build a large house, then this will not be possible, the building cannot occupy a large area, and you can build a country house in height, but not more than 2 floors. Everything is different, if the land is intended for permanent residence, on such a place you can build a house not exceeding three floors. If there are more than 3 floors, then it is illegal, this is already a high-rise building.

Allotment area

  • for sites under federal ownership, standards are established in accordance with federal laws;
  • Regional laws apply to lands that are in regional ownership;
  • The size of municipally owned land plots is regulated by municipal regulations.

Regulations and rules

  1. In the search bar of your browser, you must enter the request “Land Use and Development Rules” and the name of the locality or region, region
  2. In the document that opens, look for an article whose title includes the phrase “parameters of permitted construction.” You will find the information you need about the maximum size of individual housing construction plots there

  1. 6 acres - we remember how many meters this is, so we can conclude that this is a small area. It is for this reason that you should not place all objects separately from each other, because some of them can be combined with each other, for example, a house can be combined with a garage and a utility block, and a bathhouse with a woodshed.
  2. When planting trees and installing buildings, you cannot distribute them on the south side of the land, as shadow will fall on the remaining part, because of this, your crops and flower garden may not grow.
  3. The house and garage should not be built in the middle of the entire territory, or in the opposite direction to the entrance.

Construction of houses on three acres of land

There is also bad news - for citizens with three or more children, changes have been made to Article 39.5 of the Land Code. Now the regions have been given the right to provide support only to those families that are registered as needing improved housing conditions or meet this status (up to 11 square meters of housing per person). That is, they will give you a choice of either a plot or another form of support. Most likely, the new rule will begin to apply to other categories of beneficiaries who want to receive land for individual housing construction within the city.

  • Land legislation has the concept of a maximum minimum plot size. This indicator differs for different categories of land. The area of the cuts should not be larger than this indicator. If there are more excess lands, they cannot be legalized. For example, the minimum plot area for SNT is 6 acres. This means that you can add at most the same area to your “legal” six hundred square meters in the village. There is another important point in this rule of law that cannot be ignored. The fact is that the minimum size of land is set by local authorities, not federal ones. And it may turn out that in some regions there are simply no such standards. In this case, you can cut no more than one tenth of your plot.
  • It is important to remember one more point. When you order land surveying, you must provide documents for the land. And these documents indicate the storage area. When the actual area differs, the cadastral engineer must not only set new boundaries, but also justify the deviations. Actual boundaries must exist for at least 15 years and be secured by some kind of objects. Objects can be natural or artificial. It is important that they allow one to accurately determine where the boundaries of the land lie.

When is the easiest time to legitimize “extra” space?

  1. Carry out land surveying. You can order surveying from our company. Our specialists will establish exact boundaries and area and coordinate them with the neighbors. This will protect you from the risk of being drawn into lengthy boundary disputes.
  2. Submit an application for inclusion of updated information about boundaries in the Register. Now boundary surveying has become mandatory, and it must be carried out before registering a plot of land. For old plots in the Register there is a note “borders have not been established.” The owner of such a plot has the right to contact Rosreestr with an application to enter additional data.
  3. Receive an extract from the Unified State Register with updated data. If all legal requirements are met. There are no problems with clarifying data on boundaries. But Rosreestr may refuse if it reveals any violations. We will help you avoid problems when legitimizing excess land. Our specialist will tell you about all the nuances of the procedure in your case during your consultation.

Reading your memo, I just can’t understand where you got it from: “Next, step back 1 meter from the border of the plots established by surveyors (more is possible, but not 1 cm less!) and install a blind fence of the height you need.” Why 1 meter. If possible, write an answer since my neighbor refers to your article. The joint venture does not say anything about 1 meter. Clause 7.9 gives a loophole to legally erect a blind 2m fence by retreating 2m from the boundary, organizing something like an apiary.

Distance to city

The first factor when choosing a site is the distance to the city. Even if everyone who will live in the house works and studies remotely or is retired and does not directly depend on large settlements, nevertheless, the condition of proximity to a metropolis or large village is mandatory. This is due to the following number of necessary circumstances:

  1. Replenishment of food and material base.
  2. Use of medical services, including emergency ones.
  3. Interaction with emergency services during the development of an emergency.
  4. Visiting other objects of interest (clubs, theaters, shops, exhibitions, etc.).

In addition, modern man is accustomed to living in society - he needs communication. It is unlikely that anyone will be able to leave the team, friends, or relatives for a long time. Therefore, from this point of view, you also need to know how to choose a site for building a house, so that, due to making a hasty emotional decision, you do not end up in social isolation for a long time.

House with a plot in the suburbs

A dwelling in the wilderness is good only for periodic residence. It will be useful for weekend trips, picnics, fishing, and hunting. For permanent residence, it is better to choose a place as close as possible to a large city, in the suburbs or in its more or less ecological region.

The site should not be too remote, but also not located near a busy part of the city. Its location is optimal when the following conditions are met:

  1. It takes no longer than 1-1.5 hours to get to work/study/business meeting.
  2. It takes no more than half an hour to get to the nearest kindergarten or school by your own car, taxi, train or bus.
  3. Densely populated areas, busy highways or industrial enterprises are located on the other side of the city.

Interesting fact! Since in most cases the limiting factor in choosing land for a house is cost, it turns out to be more profitable to buy outside the city. The price for a plot outside the city limits on average drops 10 times compared to a place of similar size in a metropolis.

Minimum

In conditions of dense urban development or on federal lands, it is impossible to allocate huge plots of land to everyone, in contrast to territories in a state of development (for example, the Far East).

Regulations and rules

The general minimum indicator for the size of an individual housing construction plot is practically not used in real construction, since each region or municipality adopts its own regulations .
