Technical documents for a house are of great importance; without them it is impossible to register ownership and conduct legal transactions. Most real estate owners confuse the concepts of cadastral and technical passports, considering them similar, and are in no hurry to issue the latter.

Why is it needed and what information does it contain?

A registration certificate for a home is widely used in various fields. Its use is necessary in the following cases:

  • when it is necessary to put the house into operation;
  • when the issue of inheritance or shared division of a house is being decided;

  • considered by notaries during home purchase and sale transactions;
  • if it is necessary to issue a deed of gift for the house;
  • necessary when remodeling a building, constructing and extending various types of structures, as well as when changing internal communications.

ATTENTION – the document confirms that the technical condition of the house is in perfect order, no changes have been made.

The technical passport for the house contains informational information about the property. it contains the following information and characteristics:

  • date of construction and its type;
  • area of ​​the object, dimensions (separately indicated when the last time major repairs were carried out);
  • the degree of wear and tear of the house is indicated;
  • building material (what it is made of, sheathed, what kind of insulation is installed, the thickness and material of the walls, ceilings, what type of roof and foundation are made);
  • network engineering;
  • cost according to inventory;
  • number of rooms (area of ​​each).

Additional information:

  • sizes - bathrooms, kitchens, balconies, toilets.

The document must display a complete description of the “house” object.

Is a technical passport required for a non-residential building, a country house?

The cadastral passport for a private blast furnace is the only document that needs to be obtained. It is also required to produce a technical passport for the building. A passport is ordered from the BTI. Before issuing a document, a government agency employee will visit the site for a comprehensive inspection, during which violations may be identified. If the building complies with building regulations and safety criteria, then creating a technical passport will not take more than two weeks.

The technical plan describes the characteristics of the constructed object, its area, number of storeys, coordinates of the house, floor plan, site plan and the conclusion that the external boundaries of the residential building are within the boundaries of the land plot.

Legislation

According to the law, the technical passport is considered in Federal Law No. 221 “On Cadastral Activities”.

According to the law, technical documentation (technical plan, passport, cadastral plan) has the same legal significance as the cadastral passport of a real estate property. And also Federal Law No. 122 “On state registration of rights to real estate and transactions with it.”

Decorating a house under the dacha amnesty

The main condition for registering a house on a dacha plot is obtaining the right of use of the land plot by October 30, 2001. If you received land before this date, and you built a house before or after this date, then you are also subject to this law.

  1. You register the land and the building separately. That is, the land has its own cadastral number, and the capital construction object has its own identifier.
  2. You must contact Rosreestr to register your right, paying a state fee of 350 rubles.
  3. We provide documents confirming your identity as the owner, in this case a passport of a citizen of the Russian Federation.
  4. We present evidence of the right to use the land (that is, you need documentary evidence that you have the right to dispose of the land). This document can be obtained from the SNT horticulture board, and if it is impossible to obtain such a document, contact the local real estate or property law department. There you should be given a certificate based on the archival data of the BTI, orders of local authorities of both Russia and the RSFSR.
  5. If you previously registered land under the dacha amnesty and built a house, then you just need to present an extract from the Unified State Register of Real Estate (only current on the day of application).
  6. If you started building a house, you should have previously obtained a building permit. We present the permit to Rosreestr.
  7. We contact a cadastral engineer who will develop a technical passport for the house.
  8. If you are planning to build a house, or have started to build it, then as of August 4, the Construction Permit has been canceled. A Notice to Local Authorities must be completed. Where is it made and how to get it?

The registration certificate for the house is prepared by the BTI or a land management company (you can apply via the Internet).
You can also order the document in the appropriate paragraph on the State Services portal. When using the services of the latter, the cost of documentation will be more expensive. The BTI stores all information about real estate. To receive the document you must:

For a private house

  • apply to the BTI;
  • make an appointment with a technical engineer;
  • take measurements and set a date when the document can be picked up.

To a new home

  • a technical passport must be obtained before the certificate of ownership of real estate in order to put the building into operation;
  • order the visit of an engineer from BTI;
  • take measurements;
  • The data will be entered into the passport and given to the property owner.

Who can apply?

An application to the BTI or land management company is submitted personally by the legal owner of the property. Or an authorized person can submit an application if he/she has the appropriate document.

IMPORTANT – the power of attorney must be notarized.

Where can I get a copy?

Since all technical information is stored and processed in the Technical Inventory Bureau, to make a copy it is enough to contact the BTI staff . You can also request a copy from the cadastral engineer who took the measurements and filled out the form, and first ask about the availability of information.

How to obtain a technical passport for a country house?

To obtain a technical passport, you will need to contact a BTI engineer at the location of the land plot and building. The document is drawn up according to the application procedure. The availability of a technical plan for the building (cadastral passport) and the compliance of the building with the standards of country and housing construction are taken into account.

What is important is the presence of a title document for the country house and plot - an alienation agreement, a certificate, an extract from the Unified State Register of Real Estate.

How to apply: required documents

The following documents will be required for registration:

  • an application for a technical passport indicating the reason for receipt (can be sent online at State Services or written on site at the BTI);
  • owner's civil passport;
  • if through a representative - a power of attorney certified by a notary;
  • title document – ​​certificate of ownership of the property;
  • receipt for payment of state duty.

Technical passport of a country house

The document must include a title page, as well as a table indicating the parameters of the structure. Difficulties in registration may arise when a house is built without permission.

Before drawing up the document, it is advisable to obtain a construction permit or legalize unauthorized construction in court.

You can issue a technical passport only if you have ownership rights to the country house.

To the garden

A garden house requires no more than two or three rooms, with an outbuilding and a gazebo. The technical passport for the building is issued at the BTI. Before this, you need to make sure that ownership of the house and land has been established.

The technical passport for a garden house contains detailed information about the structure, the material used to make it, information about supporting structures and other technical data.

To the unfinished

To obtain a technical passport for an unfinished house, you need the status of such real estate as an unfinished construction project.

It should be formalized in the BTI or in court if the citizen does not meet the construction period allotted in the building permit.

An unfinished object should be distinguished from an unauthorized building, which can be completely erected, but without the appropriate permission from the municipal authorities.

The registration certificate for an unfinished house is temporary. The information in the document may change depending on the stage of readiness of the object.

Where to order: intermediary services

  • MFC - when ordering through a multifunctional center, we contact the local branch, fill out an application, pay a receipt for the state fee and provide a package of documents. On the copy of the application, the MFC employee will indicate the date of arrival of the engineer and the date of production of the passport;

ATTENTION – you will have to go to the BTI to get it.

  • State Services portal – you must register on the portal. Through your personal account, go to the appropriate section - issuing technical documentation, fill out the form, pay the receipt online, and upload scanned documents. We pick up the finished document at the BTI upon receipt of an SMS notification;
  • through Rosreestr - on the website we go to the section for issuing technical documentation, select a suitable city with a BTI department, then go through a survey and fill out an application, leaving contacts for feedback (phone, email). You will receive a notification that you need to come with the originals to the BTI and continue registration. You won't have to stand in line.

Other documents

The most mysterious item in the list of technical documentation is “other documents”. The fact is that thanks to this clause, the list becomes essentially open; it can include any documents that have something to do with the management of apartment buildings. It is enough that the decision to include any of the documents in the technical documentation is made at the OSS by a simple majority of votes.

Such an “additional” document could be, for example, an agreement with a contractor or even some internal document of the management company - a salary sheet or staffing table. Please note that if such a decision is made at the OSS and agreed upon with the MA, the document will be included in the technical documentation. This means that then the owners will have the right to get acquainted with it.

The management company has the opportunity to anticipate such developments even at the stage of concluding a management agreement : it is enough to simply add a closed list of documents to it, having agreed upon it with the owners. Then the owners will not have the opportunity to expand this list.

Production time and service cost

Within seven days, the application and application are reviewed at the BTI branch (or intermediary), then the bureau employees ask the owner to appear at the branch.

If measurements are required, an additional meeting with an engineer is scheduled. From application to production it takes from three to fourteen days. The cost of the service varies depending on the regional location of the property, as well as the prices of land management companies. The minimum state duty is 1,500 to 2,500 rubles.

Issue a registration certificate for a house in SNT
