Laws, housing and communal services regulations and rules in 2021

There is no such regulation or normative act that obliges to assign a separate cleaner to each front door. One employee can be responsible for cleanliness at several sites. If the management company does not provide a specialist for cleaning, then it is violating current legislation.

The rules for wet and other cleaning of entrances and staircases, with a list of mandatory work and their frequency, are reflected in the following regulations:

  1. GOST R 51617-2014 is a state standard that specifies in detail housing and communal services and the rules for their provision to the population;
  2. Government Resolution No. 290. According to this document, the management company is responsible for the condition of the entrance;

  4. Resolution of the State Construction Committee of the Russian Federation No. 170 dated September 27, 2003;

These documents clearly state what is included in cleaning the entrance and who is responsible for monitoring it.

Entrance cleaning standards

Clause 23 of the RF PP dated 04/03/2013 No. 290 provides a list of work on the maintenance of premises included in the common property in the apartment building:

  • dry and wet cleaning of vestibules, halls, corridors, galleries, elevator landings and elevator halls and cabins, landings and flights, ramps;
  • wet wiping of window sills, window grilles, stair railings, cabinets for electric meters of low-current devices, mailboxes, door frames, door leaves, closers, door handles;
  • window cleaning;
  • cleaning protection systems from dirt: metal gratings, cellular coverings, pits, textile mats;
  • carrying out deratization and disinfestation.

Decree of the State Construction Committee of the Russian Federation dated September 27, 2003 No. 170 states that the management company must ensure:

  • required sanitary condition of staircases;
  • simultaneous ventilation of staircases of the lower and upper floors through open vents, windows, transoms or ventilation ducts.

The work schedule for the maintenance of staircases is drawn up in accordance with clause 3.2.7 of the resolution of the State Construction Committee of the Russian Federation dated September 27, 2003 No. 170.

What needs to be cleaned?

All rules and recommendations are specified in regulations and in job descriptions of housing and communal services workers. The following are subject to cleaning:

  • wet sweep the flights of stairs and landings on the first two floors every day, excluding Sundays, as well as holidays;
  • the same types of activities, only on the following floors, starting from the third, if the building: does not have a garbage chute and an elevator, the frequency of cleaning is at least twice within one week;
  • if there is a garbage chute, then its frequency is the same;
  • there is only one elevator or another garbage chute, it is enough to clean up the mess up to once a week;

  • clean the floors in elevator cabins six times a week, excluding all Sundays and holidays;
  • It is necessary to wipe with a damp cloth or brush the doors, walls, lampshades, and ceilings of elevator cabins in entrances where there is a garbage chute at least twice a month;
  • washing windows, their bars, attic stairs, electric meter cabinets, low-current devices, mailboxes, sweeping dust from ceilings is required once every year;
  • Heating devices and window sills should be washed from dirt and dust at least twice every year;
  • clean the areas at the entrance to the entrances, wipe down metal grates and pits at least once a week.
    • carrying out wet and dry cleaning in halls, vestibules, galleries, corridors, elevator cabins and landings, ramps, staircases;
    • wiping dust that covers window grilles, window sills, stair railings, electric meter cabinets, mailboxes, low-current devices, door leaves, frames and handles, closers;
    • cleaning window glass;

    What types of cleaning work should be carried out?

    According to existing standards, three types of cleaning are regularly carried out at entrances: wet, dry and sanitary .

    Each type of cleaning has its own rules and regularity.

    Dry

    Carried out more frequently. It consists of wiping dust on all surfaces, as well as sweeping staircases, corridors, and utility rooms. You can also use a dry broom to sweep away debris from ceilings with cobwebs.

    Wet

    It is carried out less frequently and consists of washing floors on the stairs, in the elevator, and in utility rooms. Must be included:

    1. wet cleaning of window sills;
    2. window cleaning;
    3. batteries;
    4. gratings;
    5. railing

    Sanitary

If a responsible company does not monitor the situation with this process, then it is a clear violation of the law.

    Rules for cleaning an apartment building are specified in special documentation in accordance with GOST R 51617-2014. In case of violations, the performer is responsible.     Periodicity

    The order describes in detail what types of work must be carried out daily or once a week, and what types of work must be carried out once a month or once a year.     Work periods

    The frequency of cleaning staircases in an apartment building is regulated by the methodological manual MDK 2-04.2004, developed on the basis of the Civil Code. Carried out according to the given order:

    4. Disinfection is carried out monthly.

    The composition of cleaning the entrance of an apartment building, in addition to washing the stairs, includes much more. What you need to pay attention to to assess cleanliness:

    1. Maintaining frequency in corridor openings.
    2. Cleaning the elevator and keeping it clean.
    3. Wiping off dust.
    4. Cleaning mailboxes.
    5. Treatment of doors and handles.
    6. Ventilation of the room.

    Who should clean the entrances?

    Previously, the responsibility for caring for the house fell entirely on the shoulders of the residents. Cleaning schedules were drawn up, and the owners took turns keeping order. After the Russian government adopted Resolution No. 290, the opportunity arose to improve the situation.

    According to Article 36 of the Housing Code, the responsible organization is obliged to carry out cleaning of entrances in compliance with sanitary standards, and make major repairs, in accordance with the established procedure. Responsible persons are elected at a general meeting of residents by voting. The main companies that can take responsibility for cleaning for HOAs, housing cooperatives or other organizations are identified. An agreement is signed, which specifies the entire list of services provided, the frequency of cleaning entrances in an apartment building and the amount of payment (Article 162 of the Housing Code of the Russian Federation). Cleaning costs are included in the payment and are indicated as the amount for major repairs and cleaning.

    Who is responsible for cleaning up after renovation?

    After renovation, many questions arise, one of them is who exactly should clean up the resulting mess. It all depends on who left the garbage and how the agreement was drawn up with the organization carrying out the repair work and with the management company.

    If the garbage was left by the company that carried out the work

    In this case, everything depends on the contract. Initially, it should have included a “Cleaning after renovation” item. If there is such a point, then the repairmen themselves must clean it. If there is no such point, then the responsibility for cleaning lies with those who are always responsible for the cleanliness of the entrance.

    If the dirt was left by the residents themselves

    If residents independently carried out repairs in their entrance, then they had to agree on cleaning after the repair in advance.

    At a general meeting, such an issue is resolved either in favor of hiring a cleaning company, or the residents clean themselves. Even if the cleaning will be done by the residents of the entrance, it is necessary to clarify this in the minutes of the meeting and reflect the voting process there.

    What does the price consist of?

    The final cost of cleaning entrances consists of a number of factors, including:

    • the amount that covers the cost of staff salaries;
    • the time a person spends on cleaning;
    • frequency of work;
    • spending on special equipment and uniforms;
    • tax expenses;
    • volume of upcoming work (number of floors of the building, number of entrances in it).

    By estimating the cost of each item and adding up the resulting numbers, you will be able to calculate the cost of cleaning the entrance. It is paid by the owners living in apartment buildings by transferring funds for the maintenance and repair of the residential premises.

    The specific amount is discussed at the general meeting of residents. It must be documented. If necessary, tariffs are revised after a year.

    Where to complain and what to do if they don’t clean it up?

    Unfortunately, poor quality of cleaning in hallways is becoming the norm . Increasingly, residents of apartment buildings are faced with the negligence of the management company, which regularly collects money but does not deal with the issue of cleaning. Just swearing is really useless.

    Pre-trial proceedings

    First, you need to complain directly to the company that collects money for cleaning. If this is a management company, then they are obliged to respond and advise the residents of the house about the inadequate quality of cleaning. If the Criminal Code does not respond to complaints, then the following authorities for pre-trial proceedings:

    • Rospotrebnadzor.
    • State housing inspection.
    • Prosecutor's office.
    • District or city administration.

    Usually the Manager reacts to the first complaints from residents about dirt in the entrances. But there are also difficult situations.

    Required documents and evidence

    It is necessary to draw up an act on improper cleaning of the apartment building entrance, which will reflect all the shortcomings made by the management company. It is advisable to invite representatives of the company to record violations; if they do not appear at the appointed time, then you can take 2-3 people from the residents of the apartment building as witnesses.     Drawing up an application

    First of all, you must send a complaint to the management company in the form of an application. It is compiled in free form, but should consist of three parts:

    1. A cap. It indicates to whom exactly the complaint was sent, the name of the organization, address and telephone number, as well as the contact details of the applicant. If there are several applicants, then it is necessary to list all of them, indicating their contact information.
    2. In the main part, all tenants’ claims should be presented in as much detail as possible, with possible details.
    3. Conclusion with signature and date. At the end of the document there must be signatures of all applicants, if there are several.

    There are a number of rules for filing an application with the Criminal Code:

    1. The application must be completed in two copies. Then it will be possible to prove that some of the residents’ demands have not been met.
    2. Both copies must be registered at the company office. If the office refuses to register the application, then it must be sent by registered mail with notification.
    3. It is allowed to resort to a collective statement if the order in the entrance does not suit several residents at once. This will have more weight for the management company.

    The building management must send a special commission that will check the complaints of apartment building residents. After this, violations must be eliminated as soon as possible. If the management company does not respond to the complaint, you can go to complain to higher authorities.

    Terms of consideration

    Complaints in government organizations must be considered within a month , Art. 12 Federal Law No. 59, an organization that manages an apartment building is required to respond to an appeal within 5 days, clause 40 of PP 491.

    If no response is received during this period, then residents have every right to apply to the courts with a statement of claim. Typically, the response of the Management Company is faster, especially since it is in the interests of the responsible persons to prevent appeals to higher authorities.

    Trial

    If no arguments work, the only option is to go to court. The claim can be either individual or collective. The latter will have more weight. The statement of claim should include claims and statements submitted by the organization prior to the trial.

    On what grounds can they refuse and what to do in this case?

    The claim may be rejected if the Management Company can prove that the cleaning organization acts in accordance with the concluded agreement and in accordance with the law. If the residents are not satisfied with this, then the apartment owners always have the right to convene a general meeting of owners and re-elect the method of managing the house.

    What are the standards for cleaning the entrances of apartment buildings in 2021?

    • name of the organ;

    • information that the appeal was sent to the Criminal Code, which ignored it;

    Decree of the Government of the Russian Federation No. 290 dated 04/03/2021 approved the minimum size of work (their list).     Responsibility of the management company

    2. Recalculation of utility bills with an obligation to return money for the period when cleaning services were not provided, PP No. 354.
    3. If, as a result of failure to fulfill its obligations, any harm was caused, the management company may be required to compensate for both material and moral damage.

    But in any case, this must be decided by higher authorities or supervisory authorities.
