The ZhBU act is drawn up in the form indicated below. But the goals of its preparation may be slightly different: this may be a basis for subsequent improvement of living conditions in your family (due to the fact that they are recognized as poor, not meeting the standards of living, square footage, condition of the housing stock, recognition of your family as low-income, or the family has serious illnesses of the providers), and to clarify the moral situation in the family where a minor or a pensioner lives.

ZHBU Act – Living Conditions Inspection Act is a document describing the living conditions of the applicant or other person.

It contains information:

  • type of layout;
  • general condition of the house and apartment;
  • quality of repair;
  • availability and list of communications;
  • heating type, etc.

The document may also contain information about the family itself, the psychological situation in the apartment, and the relationship between parents and children.

On April 20, 2021, I checked the living conditions of the student of grade 7 “B” of MBOU “Secondary School No. 125” in Zhukovsky, Bogdan Dmitrievich Shcherbinin.

Family composition: complete. Mother - Shcherbinina Anna Romanovna, father - Shcherbinin Dmitry Timurovich, younger sister - Shcherbinina Alisa Dmitrievna.

All family members live together in apartment No. 48 at the address: Moscow region, Zhukovsky, Lenina Ave., 205. The apartment with amenities is located on the 6th floor of a 12-story brick building, total area 56 sq. m. m.

Student Shcherbinin B.D. lives in a living room with an area of ​​25 sq. m., together with his younger sister (attends a preschool). Part of the room is allocated to separate sleeping areas. There are 2 separate workstations equipped with stationery and school supplies. There is a horizontal bar for sports and a shared play area. The child has the conditions for proper rest, sleep and study.

No violations of sanitary and hygienic standards were found during the inspection. The apartment is clean, warm, things are laid out neatly. All family members look neat.

Mother and father work at a permanent place of work, the family income is average. Children are provided with clothing, proper nutrition, and attend additional sections and clubs. Family relatives (grandparents) live separately. They visit them weekly.

The commission’s conclusion: no obvious signs of trouble were found when visiting the family. There are good friendly relations between family members. The child is provided with everything necessary according to his age.

Now let’s talk a little more about how an act of examining a family’s living conditions can be drawn up. The following describes the points of the document, as they are added, from top to bottom.

The first part concerns general information about the property and residents:

  1. Name: “Act of inspection of housing and living conditions.”
  2. Property address and type (apartment, house, etc.).
  3. Composition of the commission.
  4. Who owns it?
  5. Real estate survey results: number of rooms, area, landscaping.
  6. Date of examination.
  7. Full name and position of the persons who conducted the survey.

The second part of the act examines the living conditions of the minor and, as a consequence, the state of his health, upbringing and education:

  1. Full name, date of birth, place of education of the child.
  2. Details of the child’s parents/guardians: full name, date of birth, place of work and position held.
  3. Information directly about the child: Health status. Level of physical development, signs of disease, presence or absence of traces of mental or physical abuse.
  4. Appearance. This applies to general hygiene and having suitable clothing and footwear for all seasons.
  5. The level of education. How regularly does the child attend an educational institution, how is he doing with his academic performance and, if there are difficulties with his studies, what are the reasons for them (illness, moving, participation in extracurricular activities, etc.).
  • Social adaptation. This means how much the child is able to make contact, what kind of answers he gives to questions (complete or monosyllabic), what kind of relationships he has with other family members (friendly or conflicting), whether he can take initiative, etc.
  • Level of education. How the child communicates, the composition of his vocabulary, the attitude towards difficulties of other family members.
  • The third part takes a closer look at the condition of the property in which the child lives:

    1. Type of premises: Khrushchev, “hotel”, availability of privatization, total area.
    2. The condition of the building where the apartment is located. Cleanliness of the entrance, availability of repairs and other similar factors.
    3. Cleanliness and comfort (or lack thereof) in the apartment itself, the child having a separate room and place for study and relaxation, etc.
    4. The approximate level of family income, whether it needs financial assistance, and if so, in what form.

    The final part includes two components:

    • Conclusions about the state of housing and the atmosphere in the family.
    • Recommendations for improving/correcting the situation.

    What should the Act contain?

    The housing inspection report is drawn up in free form, and its structure is determined by the purpose. The general requirement for such documents (in order to have the force of evidence in a civil case or have legal significance) is:

    1. Availability of a date for conducting a housing inspection. It may coincide with the date of drawing up the act, or it may differ (the act must be drawn up no later than 3 days after visiting the property)
    2. Name of the document (act), date and place of its publication
    3. Members of the commission and the purpose of the inspection (we are checking the student, in connection with a complaint from neighbors, etc.)
    4. Object of study (address) and characteristics of housing (house, apartment, area, how many rooms, who owns it, in which house it is located, amenities, etc.)
    5. Who lives in the apartment - family composition, other relatives or other persons living together, sometimes their place of work and income, behavior, appearance
    6. Availability of pets, cleanliness, arrangement, etc.

    The document may contain conclusions and conclusions about the compliance of housing and sanitary conditions with standards. The act of examining housing conditions is signed only by members of the commission, but the persons whose living conditions were checked and their legal representatives have the right to familiarize themselves with the document.

    If the child is a minor and the purposes of the Inspection Report

    It is required to examine the living conditions of a minor child in several cases:

    • The child constantly violates discipline at school : he participates in fights, insults peers and teachers), he receives complaints from teachers, students, parents, and comes in drunk or in a state of drug intoxication. The minor talks about suicide, attempts to commit suicide, and threatens adults and children.

    How to fill out an inspection report on the living conditions of a minor and his family

    The act is drawn up in free form, manually or in printed form, drawn up in at least 2 copies, one of which is handed over to the inspection organizer.

    To do this, a commission first gathers and families are visited. The commission includes:

    • a school representative (class teacher, school psychologist or other teacher);
    • parent committee representative;
    • representative from the guardianship authorities.

    If necessary, a representative of the Ministry of Internal Affairs - a district police officer - is included in the commission. This is required when registering a child with the police, or when a teenager violates the Code of Administrative Offenses or initiates a criminal case.

    The result of the inspection of material and living conditions is entered into the act; in addition, the following is written in the text:

    • title of the paper, place of preparation;
    • date of inspection and date of actual drawing up of the document;
    • information about the members of the commission (full name, which organization represents the interests, position of the employee);
    • who is the object of assessment, at what address the inspection was carried out;
    • results;
    • signatures of the parties.

    Parents can be familiarized with the text of the act upon their request, but their signatures on the document are not required.

    In what places should this Act be submitted?

    The inspection report is available upon request to several organizations:

    1. In Social Security: to be recognized as needing improved housing conditions. More precisely, the concept of “Sobes” from the USSR no longer exists; now this term refers to Social Protection Bodies. To receive a subsidy or benefit, a citizen contacts the local social security department. In addition, in large cities there are various multifunctional centers where you can also arrange everything.
    2. To the State Housing Inspectorate: to apply for a subsidy to improve housing conditions
    3. To the guardianship and trusteeship authorities (including the education department): for the adoption of a child from an orphanage and in case of systematic violations of the rights of the child
    4. To school , to juvenile affairs representatives: in case of unsatisfactory social behavior of the child

    It will not be possible to get on the waiting list to receive a subsidy and improve your living conditions without drawing up this act.

    Therefore, a request to create a commission must be made in advance.

    Remember:

    1. To participate in the state program to improve housing conditions. A certificate is required (this is the Act, it is called a certificate or Act) about checking the living conditions. The act is one of the options for drawing up a document of this type, and therefore has equal force. The difference is that the act contains more detailed information about the condition of the apartment or private house. The document can also include information about existing debt on utility bills, if necessary.
    2. An inspection of living conditions can be carried out either by prior agreement on the time of arrival of the commission, or unexpectedly . The second option is common when studying the place of residence of a minor, when it is necessary to study the standard of living and the typical environment for the family.
    3. If the homeowner does not agree with the drawn up act, then he can appeal the document to the Housing Inspectorate . If the request is satisfied, a repeat inspection will be organized.
    4. The home inspection report has a limited validity period. After 30 days the document will have to be redone.

    Where can I get a certificate?

    You can order and obtain a certificate of examination of the living conditions and financial security of the family from the social protection authorities. At the same time, as mentioned above, other structures, including even the Ministry of Internal Affairs (Ministry of Internal Affairs), can initiate the inspection.

    Several years ago, changes appeared in the legislation, thanks to which low-income citizens had the opportunity to improve their living conditions at the expense of the state.

    The Housing Code of the Russian Federation determines the list of citizens who are entitled to receive a free housing subsidy. It includes persons forced to live in premises unsuitable for normal living and at the same time beyond repair. Help is also provided to citizens with serious illnesses and orphans.

    Article 52 of the RF Housing Code states that in order to receive state support, a citizen is required to collect a package of documents. It must include a certificate of verification of living conditions. The collected papers are submitted to social authorities at the place of residence. The act of checking the living conditions is an integral part of the package of documents for judicial resolution of issues relating to the living conditions of the child.

    The body carrying out registration independently requests documents (their copies or the information contained in them) necessary for the registration of a citizen from state authorities, local government bodies and organizations subordinate to state bodies or local government bodies, which have the data at their disposal. documents (their copies or information contained in them) in accordance with regulatory legal acts of the Russian Federation, regulatory legal acts of constituent entities of the Russian Federation, municipal legal acts, if such documents were not submitted by the applicant on his own initiative.

    Registration of the act

    The housing inspection report must be drawn up within three days after completion of the inspection. The document is drawn up in two copies, each of which is certified by the head of the institution that initiated the inspection.

    An act on checking the living conditions of a minor for submitting a document to the Ministry of Internal Affairs is drawn up in cases where:
