First, a few words about how water fees are generally calculated? In what cases is payment for water consumption made by meter, and when by other means?

Now let's move on to the situation with buying an apartment. First of all, you need to ask the seller how he pays for water?

There are three options here.

First . The previous owner regularly reported meter readings and paid for water based on these readings. At the same time, the meters are in good working order and their verification period has not expired. This is the most understandable and convenient option. There will be no debt left from the previous owner.

Second . There are no meters in the apartment. Or the metering devices are there, but their verification period has expired. The apartment owner pays for water according to the standard using an increasing factor of 1.5. If he pays regularly and there is no debt on his personal account, then the new owner will not receive the debt as an “inheritance”.

Third . The apartment has water meters. They are in good working order, the verification period has not expired. However, the previous owner did not transmit meter readings. Next, water charges are recalculated. The algorithm here is as follows: from the most “recent” transmitted water meter readings, the latest readings transmitted by the previous owner are subtracted. From the resulting volume of consumption, the volume that was calculated (and already paid) according to the standard is subtracted.

The difference is presented to the new owner of the apartment for payment.

Although, we note, another situation is also possible - recalculation towards a reduction in water charges. After all, according to the standard, water fees are calculated based on the number of registered residents. If there are many of them officially registered, let’s say five.

If there is actually only one person living, or the apartment has been empty for a long time (there was no consumption), then after transmitting the meter readings, the utility companies must return the overpaid money.

They are, of course, returned not in cash, but by offsetting future payments. But that's the point.

However, let’s return to the situation when the new owner is charged an additional large amount for water. What can be done about this?

On the one hand, the current legislation clearly indicates that the debt for payment of housing and communal services is not registered with the apartment, but with the owner.

In particular, the Housing Code (Article 153, paragraph 5) states that “the obligation to pay for residential premises and utilities” for the owner of residential premises arises “from the moment the ownership of such premises arises.”

The moment of emergence of ownership rights is determined by clause 2 of Art. 223 of the Civil Code of the Russian Federation. It states: “in cases where the alienation of property is subject to state registration, the acquirer’s right of ownership arises from the moment of such registration, unless otherwise provided by law.”

Thus, the new owner is not obliged to pay for utilities provided before the registration of his ownership rights. The previous owner of the apartment is required to pay for them.

This rule, however, directly applies to cases when “fresh” meter readings become known to utility workers as a result of checking the meter.

But in fact, it also applies in cases where the owner himself (in this case, the new owner) gives testimony.

It is formulated as follows:

... unless the consumer proves otherwise, the volume (quantity) of the utility resource in the amount of the identified difference in readings (i.e. those that were available to the utility providers and the new ones that were received under the new owner - EnergoVOPROS.ru) is considered consumed by the consumer within the billing period in which the contractor carried out the inspection. ...

— We will proceed from the fact that the previous owner did not transmit meter readings for a year, while his metering devices were in working order and the period for their verification had not expired.

— Let’s say a transaction with an apartment is registered in March. In April, the new owner has no time for meters; he solves other problems. Meter readings are reported at the end of May.

— And at the beginning of June he receives a payment in which the volume of water appears, calculated as the difference between the latest readings transmitted by the new owner, the latest ones transmitted by the previous owner (i.e. more than a year ago) and the volume of consumption calculated (and already paid) according to the standard.

If one person was registered in the apartment, but in fact there were four people living in it, then the amount of additional charges will be large. It is impossible to drain so much water in a couple of months. But how to prove that water consumption occurred under the previous owner?

How can you avoid paying for water that was dumped by the previous owner?

The only reliable way is to take care in advance to ensure that such a problem does not happen. Namely, enter into the apartment acceptance certificate (concluded during the transaction) data on current (at the time of the transaction) meter readings.

In this case, the new owner of the apartment will be able to reasonably prove what part of the water consumption occurred during the period when the residential premises were owned by another owner. And what kind - for the period when the apartment has already changed its owner.
