The Federal Law “On Registration of Foreign Citizens” allows citizens of Ukraine to obtain temporary registration at the address of the host country.

The receiving party for migration registration can be:

  • Russian citizens;
  • foreigners or stateless persons who have a residence permit in Russia;
  • legal entity – an enterprise in which a resident of Ukraine intends to work;
  • highly qualified specialists from among foreign citizens who own real estate - in relation to members of their families;
  • hospitals, medical centers, hotels.

The package of documents for temporary registration for citizens of Ukraine includes:

  • internal or foreign passport of a citizen of Ukraine (photocopy of the first two pages) and birth certificate of children under 14 years of age;
  • an application in the prescribed form from the owner (tenant) of the property, at whose address the registration will be processed. If there are several owners of real estate, then all co-owners of the apartment (house) must write similar applications requesting the right of temporary residence of a citizen of Ukraine in the specified living space. The issuance of temporary residence permits for citizens of Ukraine who are actually staying or planning to move to the Russian Federation is carried out in accordance with the general legally established procedure without any exceptions in comparison with citizens of other states.

In accordance with Art. 6 of Federal Law No. 115-FZ of July 25, 2002 “On the legal status of foreign citizens in the Russian Federation” (hereinafter referred to as Federal Law No. 115), a temporary residence permit is issued for a three-year period, the extension of which is not provided for by law.

Obtaining a temporary residence permit allows a Ukrainian citizen living in the Russian Federation to:

  1. Stay in the Russian Federation continuously for three years (as opposed to temporary registration, which limits continuous stay in the Russian Federation for a period of 90 days).
  2. Get officially employed. In this case, there is no need to have a labor patent; employment is carried out on the basis of a standard labor or civil law contract.
  3. Issue a TIN, register an individual entrepreneur and carry out commercial activities within the legally established framework.
  4. Receive free medical care in government health care institutions.

Restrictions regarding the validity of a temporary residence permit primarily relate to the place of residence - a citizen of Ukraine (like any other state) can live and carry out legal activities only within the region of the Russian Federation where the permit was received.

A citizen of Ukraine cannot leave the Russian Federation for a period of more than six months - violation of this restriction can lead to the cancellation of the temporary residence permit. However, this takes into account not the total, but the time of continuous absence. In addition, migrants with temporary residence permits are partially limited in employment, in particular, they cannot occupy leadership positions in civil aviation organizations.

Submission of documents for temporary registration

The documents required for migration registration are submitted by a citizen of Ukraine together with a representative of the receiving party to the territorial body of the Federal Migration Service at the place of residence.

If a Ukrainian is staying for a long period of time in a boarding house, hotel or sanatorium, then all registration actions are carried out by the administration of this institution.

It is possible to submit an application for temporary registration via telecommunications. By filling out the electronic application form on the Unified Portal of State and Municipal Services and indicating all the necessary data, the applicant receives an invitation by email to the Federal Migration Service to complete the registration procedure.

The law allows citizens of Ukraine to submit an application and attached documents by post. In this case, the notice of migration registration is filled out in two copies. The signature of the representative of the receiving party is affixed to the back of the notice. If a citizen of Ukraine is registered at the location of the legal entity, then the signature of the representative of the organization is certified by its seal. After the migration services register the foreign citizen at the place of stay, the tear-off notification coupon is returned to the receiving party.

Within three days after acceptance by the authorized person, the entire package of documents must be received by the registration authorities (FMS passport office). The legislation gives three more days to check all the papers and prepare a certificate of temporary registration. Thus, within 7 working days the process of obtaining temporary registration must be completed.

There is no registration fee for obtaining temporary registration of foreign citizens. If documents are sent to the Federal Migration Service by mail, you will have to pay a postal fee in an amount not exceeding 250 rubles.

Required documents

To successfully obtain a foreign passport, you must provide the consular department specialists with original documents and their photocopies. Copies of internal passports and international passports whose validity has expired are made from all pages where information is present.

  1. Original passport confirming the identity and citizenship of Ukraine.
  2. Expired passport (if any).

If the previous passport is stolen from the applicant or lost independently, additional documents must be provided to restore it:

  • application in free form;
  • a certificate that the applicant receives from the competent authorities of the Russian Federation confirming the loss of the passport or its theft.

If a passport is issued due to the fact that the information has become irrelevant, then you must provide:

  • passport (which must be exchanged);
  • documents confirming the need to replace your passport.

Approved tariffs for consular fees:

  • Initial registration of a passport for foreign trips – 3,440 rubles;
  • Registration of a foreign passport after the expiration of the old one - 5560 rubles;
  • Registration of a passport instead of a damaged or lost one – 8,490 rubles.

Payment is made through a terminal located in the consulate building (in this case, you will have to pay additional interest) or at a bank branch. Due to inflation, tariffs may change, and it is better to check the current cost on the official website of the embassy.

After submitting the papers and application, the consular department staff will inform you on what days and time intervals it will be possible to pick up the completed international passport. Deadlines for temporary registration of citizens of Ukraine

When registering temporary registration of Ukrainian citizens on Russian territory, a specific period is indicated during which the foreigner can reside at the residence address. Depending on the purpose of the visit, a Ukrainian can be temporarily registered for the following periods:

  • guest temporary registration – for 3 months;
  • educational temporary registration - for the entire period of study;
  • temporary work registration - for the duration of the work permit (maximum period - 12 months).

The peculiarities of temporary registration for citizens of Ukraine during a period of political crisis are that Ukrainians do not need to leave Russia to extend their temporary stay. To do this, it is enough to submit the appropriate application to the territorial office of the Federal Migration Service no later than 7 days before the expiration of the temporary registration.

The following documents are attached to the application:

  • a copy of the first two pages of the Ukrainian passport;
  • migration card (original);
  • document on temporary registration (migration registration) - photocopy.

A special registration renewal mechanism for Ukrainians is valid until August 1, 2015.

Ukrainians who arrive in Russia receive more freedom of movement and employment if they have refugee status - then they have the right to reside in the Russian Federation for three years. To obtain refugee status, a Ukrainian will need to contact the territorial body of the Federal Migration Service or directly to the border checkpoint with a corresponding application.

The petition of the established form must indicate all the circumstances that forced the Ukrainian to leave his homeland, and list information about family members - minor children.

Until the expiration of the refugee status, the migration card and passport of a citizen of Ukraine will be kept in the custody of the FMS department. He will be able to leave the territory of Russia only after the termination of his refugee status - to do this, he should contact the Federal Migration Service with an application for early renunciation of his existing status.

Permissible length of stay without registration

How long can Ukrainian citizens stay in Russia?
For temporary arrivals, a stay of 90 days is allowed every 180 days. The period is set in total for a given period, and, if necessary, can be interrupted and resumed. Further stay of Ukrainian citizens on the territory of Russia is possible only by obtaining a working patent, residence permit or temporary residence permit. Responsibility for lack of registration

According to the rules for Ukrainian citizens staying in Russia, illegal residence is a serious violation of the law. There are sanctions for this. They are assigned to both the foreigner and the receiving party. The fine ranges from 2,000 to 7,000 rubles, depending on the severity and number of violations.

The right to reside and work for Ukrainians in Russia

For legal residence in Russia for more than 90 days and official employment, a Ukrainian citizen is recommended to apply for a patent. This document replaces the work permit in the Russian Federation since January 2015. The maximum period for which a patent is issued is 12 months. If a foreigner receives a permit, he has the right to register at his place of residence for the entire duration of its validity.

To obtain a patent for the right to work in a certain region of Russia you will need:

  • application of the established form;
  • migration card, where in the section “Purpose of arrival” it is indicated “Work”;
  • internal or foreign passport of a citizen of Ukraine;
  • medical certificates confirming the absence of infectious and sexually transmitted diseases, drug addiction;
  • VHI policy (voluntary health insurance) or an agreement with a medical center for the provision of services;
  • certificate of proficiency in Russian or a document of education issued before 09/01/1991;
  • document confirming temporary registration.

The cost of a patent in 2015 is determined by regional authorities. In Moscow and the Moscow region it is 4,000 rubles per month.

It is possible to extend a patent, which is initially issued for a period of up to three months, without observing unnecessary formalities. To do this, it is enough to pay the personal income tax for the next three months one day before the expiration of the patent.

The personal income tax rate for Ukrainians with refugee status in 2015 is 13% of the amount of income.

Application deadlines for CIS citizens

An expired migration card is regarded as its absence, so closer to the expiration date you need to take care of its renewal. Upon entry, a Moldovan, Ukrainian or citizen of the LPR and DPR are required to register at the migration center in the first 7 days from the date of arrival. The exception is citizens of Tajikistan, the deadline for them is 15 days. Citizens of Kyrgyzstan, Kazakhstan, Armenia and Belarus receive a 30-day period (these countries are members of the Eurasian Union). Citizens of Kyrgyzstan also have the right to a similar amount of time.

The first migration entry is made only for 3 months. After this period, the foreigner renews registration by presenting compelling reasons for this (employment, training, illness and the need to undergo a course of treatment, rehabilitation) or leaves Russia. Armenians, Kazakhs and Kyrgyz have a longer sentence. They have an initial registration period of up to 12 months.

Important! In case of late application, the situation is equivalent to the fact that the person does not have registration. . Citizens of the CIS who do not have registration are charged with violating Article 5 Part 1 of Federal Law No. 115 “On the legal status of foreigners in Russia”

In this case, they can be fined from 2 to 5,000 rubles and expelled from the country. In addition, according to Federal Law No. 109 “On Migration Registration of Foreigners,” the option of administrative penalties in the form of a ban on entry into the country for up to 5 years is allowed.

Citizens of the CIS who do not have registration are charged with violating Article 5 Part 1 of Federal Law No. 115 “On the Legal Status of Foreigners in Russia.” In this case, they can be fined from 2 to 5,000 rubles and expelled from the country. When can a citizen of Ukraine be denied temporary registration?

Refusal to complete the procedure for temporary registration of a Ukrainian on the territory of the Russian Federation may be motivated by the following reasons:

  • lack of written consent of the owner (tenant) for temporary registration;
  • absence or non-compliance with the form of the agreement between the property owner and the tenant;
  • the foreign citizen has a chronic disease.

How can a Ukrainian stay in Russia for more than 90 days?

In connection with changes in the legislation of the Russian Federation, which came into force on January 1, 2014, a lot of confusion has arisen for ordinary citizens. I decided to answer the questions of the majority and, together with my Russian colleagues, prepared this article.

Moreover, in connection with military operations in eastern Ukraine, the flow of migrants from the Donetsk and Lugansk regions who wish to obtain refugee status in Russia has increased. However, in fact, few people are granted refugee status and people must live in Russia under general conditions. This means that after 90 days they are required to leave the territory of the state.

Those who decide to permanently stay in the Russian Federation for more than 90 days (as a refugee, migrant, for the purpose of work or just visiting) must obtain the appropriate permission, otherwise this may all have unpleasant consequences for him.

What changed?

So, the State Duma of the Russian Federation adopted amendments to the law on foreigners. Now citizens of visa-free countries cannot stay in Russia for more than 90 days in total during each six-month period (180 days). The law, designed primarily to cut off illegal migrants, also hit ordinary residents: those who travel around Russia, go on visits or on business.

In fact, the rule of a maximum stay of 3 months was in effect before, but it was easy to get around - it was enough to leave Russia for at least a couple of hours for Ukraine, Belarus or any other state, including visa-free for Ukrainians, and you could enter back for another 90 days.

The procedure for registration of registration by citizens of Ukraine

After crossing the Russian border, a migration card must be issued. It includes the purpose and duration of the visit. She is represented by employees of the vehicle in which the foreigner enters. How can a citizen of Ukraine register in Russia?

Certain steps must be taken.

  1. An application is submitted in the prescribed form, which is addressed to the head of the territorial migration authority. The planned period of registration is entered into it.
  2. A receipt for payment of the state duty and other documents are provided.
  3. Once ready, you must come and pick up the tear-off part of the form, on which the seal of the institution and the signature of the head are affixed.

The procedure for registering Ukrainian citizens in Russia has been significantly simplified. This is especially true for persons who have a voucher to a sanatorium, written consent from the host party or a hotel reservation.

The only body that carries out registration is the territorial Main Directorate for Migration and Migration. But not only personal appeal is allowed. Registration of Ukrainian citizens in Russia is carried out in one of the following ways.

A temporary residence permit is issued for 3 years. A foreigner can obtain a residence permit for the entire period, but it is possible to apply for it again. To register Ukrainians in Russia on this basis, a passport is provided with a stamp indicating a temporary residence permit. If it is issued as a separate document, it must also be submitted.

To obtain a temporary residence permit

If long-term residence in the country is required, a temporary permit is issued. When an application is submitted within the first 90 days of being in Russia, registration is not required. In cases where the period is longer, registration is issued, after which you can apply for a temporary residence permit if there are sufficient grounds.

Required documents

First of all, it is important to take care of the foundation that allows you to use the living space. This could be a lease agreement, social tenancy, or ownership.

If other persons are registered in the apartment, their consent is required regardless of the degree of relationship. Other owners should not object if the property is shared. Otherwise, the issue will not be considered. To register in Moscow for citizens of Ukraine, you must submit the following:

  • lease contract;
  • passport of the property owner;
  • identification document of a foreigner;
  • migration card.

When moving to another region, a tear-off coupon of the previously issued notice is additionally provided.
