In what cases can you check out of your apartment in 2021?

Thanks to the opening of multifunctional centers throughout Russia, every day more and more of our compatriots prefer to carry out many legal procedures related to the field of housing law through the MFC.
At the same time, registration and check-out from an apartment are among the most popular procedures. So, a person can be discharged legally in the following cases :

  • A person who was registered at a place of temporary stay is forced to move from the address indicated in his certificate.

In this case, both the person wishing to deregister and the actual tenant (that is, the owner), who previously provided the citizen with housing under the conditions established in the contract, can write a corresponding application and contact the multifunctional center.

  • A person moves out of his permanent place of residence.

In this situation, a citizen can be discharged in one of two ways:

  1. deregistration without necessarily moving to a new place of residence;
  2. an extract from the previous place of residence with simultaneous registration at the new address of residence (that is, an extract upon request).

In 2021, it is still impossible to discharge minor citizens of the Russian Federation “to nowhere” (without actual registration at a new address). To do this, you must first obtain permission from the guardianship and trusteeship authorities!

Reasons

Removal of a citizen from registration at the place of residence is possible in the following cases:

  • moving;
  • evictions;
  • loss of the right to use the apartment;
  • cessation of his nomadic or semi-nomadic lifestyle;
  • detection of illegal registration;
  • declaring him missing or dead.

Extract "to nowhere"

Such a decision entails a lot of problems, ranging from fines reaching several thousand rubles to other inconveniences when using state infrastructure. After all, registration is needed, in particular, to receive a number of medical services. However, if you firmly and consciously decided to do this (for example, you decided to sell your home, or are leaving for permanent residence abroad), then it is quite possible to check out “to nowhere.” Moreover, this is also possible with the third-party desire of the homeowner. An exception is close relatives who previously refused privatization in favor of the owner of the apartment, while retaining the right to use.

Important! Children cannot be discharged this way; authorities require registration immediately. At the same time, there are a number of requirements (the area of ​​the new premises, for example).

Methods for deregistration

There are really different ways to check out. The most common are the following:

  1. Registration immediately to a new place of residence. There is no need to deregister from the previous residential premises; it is enough to write an application for registration in the new housing. The refusal of the passport office in such a situation to require a preliminary extract is unlawful.
  2. Extract "to nowhere". The application indicates where the person intends to register in the future (any address). The MFC employee is given a passport. On average, the procedure takes 7 days.
  3. De-registration with the help of an authorized representative. If the subject does not have the opportunity to sign out on his own, this can be done by a citizen for whom the appropriate power of attorney (notarized) has been issued.
  4. Extract. You need to register on the portal. The service is provided free of charge. You must submit an application and join the queue. Having received the notification, the person must appear at the migration department of the Ministry of Internal Affairs with the necessary documents.

There is no charge for the service. If a citizen is required to pay money for an extract, he must file a complaint against the employee’s actions and submit it to the higher authorities of the center.

How to discharge a person if he has died

You can do this if you are a relative (close), owner or heir. To extract the deceased from the apartment, you will also have to collect the following documents:

  • death certificate (receive from the registry office);
  • your passport or a document replacing it;

The only effective legal way of discharge in this situation is discharge upon request. Thus, in this case, the citizen must be at a new registration address without being deregistered from his previous registration.

In this situation, all that is needed is to contact the employees of the local multifunctional center with a corresponding application for simultaneous registration in a new place with an extract from the previous address.

There are no other ways of remote discharge through the multifunctional center!

Also, due to ignorance of the legal framework, many of our compatriots are faced with a refusal to accept a package of documents when trying to register through a proxy. the whole point is that in this situation an individual must:

  1. issue a notarized power of attorney;
  2. have the application form certified by a notary office, which will need to be submitted to the MFC;

Is it possible to change registration remotely?

Extract "to nowhere"

Let's consider two situations of deregistration from an apartment without further registration in another. There are no obstacles to discharging an adult citizen “to nowhere.” When submitting an application, you are required to indicate the address where citizens are leaving - it can be specified arbitrarily, there are no sanctions for this. You can write “to nowhere”:

  • if you urgently need to sell an apartment;
  • if a person must be discharged by court decision;
  • if a person is serving a prison sentence.

But it is impossible to discharge a child under 18 years of age “to nowhere.” This is monitored by the guardianship and trusteeship department, and no specialist will risk discharging the child without their consent in writing. Even if the apartment is sold, if the child is not registered at a new address within the established time frame, the extract will be canceled, and the state registration of the right to real estate will lose its legal force.

Discharge of children

It is difficult to discharge children from an apartment, since additional certificates and permissions from authorized bodies are required . In addition, a minor child cannot be sent “to nowhere.” It is required to submit an application to the MFC for simultaneous deregistration and registration at a new place of residence.

At the same time, if a close relative of a person who wishes to be deregistered applies to the MFC for an extract, the following documents will be needed:

  • papers serving as evidence of the circumstances of the discharge (court decision, death certificate, etc.);
  • documents that certify the degree of relationship between the representatives and the person being discharged.

In addition, the applicant can provide a document according to which he has the right to dispose of housing (for example, an extract from the Unified State Register of Real Estate, a deed of gift for an apartment, etc.). Also, it is worth noting that the applicant may not bring copies of the above documents to the MFC specialist - the center employee makes them right on the spot.

Third block - result

A special feature of checking out through the MFC is that you are checking out through an intermediary. The migration service itself is responsible for deregistering citizens. Multifunctional centers only accept documents and submit them to the relevant authorities for consideration.

Refusal to provide

Many applicants are interested in the question of why it is impossible to register through the MFC and what grounds there may be for refusing to accept documents. The main reasons for refusal are:

  • the citizen did not submit all the required documents for the procedure;
  • restrictions on freedom of movement within the country, in accordance with the law “On Martial Law”;
  • there is no permission from the owner of the living space or his co-owners;

According to the law, they have no right to refuse to carry out the procedure or suspend it. They may not accept the application for registration, but if they correct the mistakes and submit the application again, they cannot refuse.

When documents can be rejected

In addition to the situation described above, citizens may receive a refusal from an MFC employee to accept documents in the following cases:

  • the content of the application cannot be read or the document was submitted by an unauthorized person;
  • documents that are required to be submitted were not provided to the MFC;
  • movement within the territory of Russia was limited by Russian legislation (for example, “martial law” was introduced).

At the same time, the law does not provide for refusal to provide the service in question or its suspension for any period. Also, every citizen has the legal right to file a complaint against an action/inaction or against the final decision of the registration authorities in the event of:

  1. refusal to correct various types of typos and errors that were made when preparing documents by employees of the multifunctional center;
  2. violation of the deadlines for the provision of public services or the deadlines for registering an application;
  3. requirements for documents that are not listed in the list approved in the Administrative Regulations;
  4. demands from the applicant for a fee that is not established by current legislation;
  5. refusal to accept documents that must be accepted in accordance with the terms of regulations.

About the timing of deregistration through the MFC in 2021

Immediately after submitting the documents and the corresponding application, the employee of the multifunctional center must give the applicant a receipt indicating the date of receipt (usually an approximate date) of the results of the service.

When registering in a place other than your own, MFC employees only need to provide written and notarized consent from the owner. If there are several property owners, the consent of each or their personal presence at the MFC on the day of submission of the application is required.
